This project was approved by the Board <br /> • of Commissioners on November 20, 1984. <br /> . Philip Post and Associates, representative of the developer, has requested <br /> that this matter be clarified by the Board of Congnissioners.' <br /> NEED: The Board of ,Commissioners approved the issuance of a Special <br /> Use Permit for a Planned Development-Housing for Homestead <br /> Road Apartments on November. 20, 1984. The Board of Commissioners <br /> • approved the Special Use Permit with the 19 conditions recommended <br /> by the Planning Board, as revised by the Board of Commissioners; <br /> with four,.(4)additional conditions recommended by the Town of <br /> - Chapel Hill; and with one additional condition added by the <br /> Board of Commissioners. The result was approval with 24 conditions <br /> • <br /> 1 <br /> Two of the conditions, as written and adopted by the B6ard <br /> of Commissioners directly conflict. These conditions are <br /> the #1 condition'of the Town of Chapel Hill and the #5 condition <br /> of the Planning Board. The Town condition calls for a public <br /> street constrUbted:.to Town.'standards and the Planning Board <br /> condition calls for the street within the interior of the <br /> property to be private. . <br /> IMPACT: The Planning Staff cannot proceed with issuance of the Special <br /> use. Permit,nor the applicant with submittal of a revised site <br /> !plan which addresses all imposed conditions,without elarifi- <br /> . cation of the Board's intention. <br /> .
