Article 5: Us2e <br /> Section 5.6: Standards for Commercial Uses <br /> (a) The amount of water anticipated to be used on a daily, weekly, mont► y, <br /> and annual basis by regulated uses located on the parcel (e.g., w. er <br /> usage by bona fide farm uses is not required to be included); <br /> (b) An analysis of the amount of groundwater withdrawal consi:ered to be <br /> safe and sustainable in the immediate vicinity; and <br /> (c) An analysis of whether other wells in the vicinity oft - proposed use are <br /> expected to be affected by withdrawals made by 'e proposed use. <br /> 5.6.15 Sexually Oriente. %usinesses <br /> (A) Submittal Req►"rements <br /> (1) In addition , the site plan submittal criteria 'etailed within Section 2.5 of this <br /> Ordinance the .pplicant shall submit pro."a license has been issued allowing for <br /> the operation of : sexually oriented b :mess in accordance with Chapter 8 of the <br /> Orange County Co•- of Ordinance . <br /> (B) Standards of Evaluation <br /> (1) Sexually oriented business■-s) shall not be located in any building, or portion <br /> thereof, that is: <br /> (a) Within 1,00' eet of an ex .,ting sexually oriented business. <br /> (b) Within 1 •00 feet of a: <br /> (i) Residential land use incl .ing any open space established as <br /> part of the residential subdi ion approval process, <br /> (ii) Church and/or place of worship, <br /> (iii) School (public, private, or specialty), <br /> (iv) Public or private library, <br /> (v) State licensed child care facility, or <br /> (vi) Public park or recreational facility. <br /> (c) Measurement shall be made in a straight line, without regar• o the <br /> intervening structures or objects, from the nearest portion of th- building <br /> or structure used as the part of the premises where a sexually ted <br /> business is conducted to the nearest portion of a building, structure, zr <br /> open space area of a use listed above. <br /> 5.6.16 Retail Trade(Sectors 44, 45; excluding cubcector 45432 of the North American Industry <br /> Classification System [NAICS])33 <br /> (A) Standards for EDH-4 and EDH-5 Zoning Districts <br /> (1) Retail Trade uses are permitted in the EDH-4 and EDH-5 zoning districts only in <br /> accordance with the following standards: <br /> (a) The retail trade use(s) is part of an overall site plan that includes at least <br /> one other permitted Principal Use. <br /> (i) The other permitted Principal Use(s) must be established prior <br /> 32 The version of the amendments the Planning Board reviewed included this language but did not include <br /> standard (2). The language was revised based on comments made by the Attorney's office;the intent of the <br /> language is unchanged. <br /> 33 These standards are being proposed in order to allow for some by-right mixed-use projects in the Hillsborough <br /> EDD while ensuring the scope of the overall project is not predominantly retail trade.
