18 <br />In the event the Premises are damaged by fire or other casualty, but not wholly destroyed <br />and/or rendered untenable which fire or casualty occurs after.Lessee has exercised its option <br />to purchase as prescribed in this Section, and this Lease is not terminated as prescribed in <br />Section 4.05, the contract to purchase and sell as prescribed in this Section is voidable at the <br />election of Lessee or Lessor and void upon the delivery of written notice prior to Closing to <br />that effect from the one voiding the contract to the other. <br />(h) Upon and after Lessee's option to purchase becoming a binding contract between Lessee <br />and Lessor for the purchase and sale of the Units, Lessor's reservation of the right as <br />contained in Section 4.02 and paragraphs 1 and 2 in Article X of the Condominium <br />Declaration, the present form of which is attached as Exhibit D hereto, to combine, <br />recombine, subdivide and/or reconfigure either or both of the Units, and/or either or both of <br />the Units and any Common Elements, shall be exercised by Lessor, if at all, only with the <br />prior written consent of Lessee. <br />(i) In the event Lessee shall exercise its option to purchase the Units as provided above, the <br />closing of the purchase and sale of the Units, including the recordation of the special <br />warranty deed and the payment of the purchase price (the "Closing"), shall occur not later <br />than five (5) business days immediately following the date of expiration of the term of this <br />Lease. <br />Section 6.15 Recordation.
