ORANGE COUNTY <br />BOARD OF COMMISSIONERS <br />WORK SESSION AGENDA ITEM ABSTRACT <br />Meeting Date: February 12, 2007 <br />Action Agend~~~ <br />Item No. <br />SUBJECT: Transfer of Development Rights (TDR) Implementation <br />DEPARTMENT: Planning and Inspections PUBLIC HEARING: (Y/N) No <br />ATTACHMENTS: <br />February 6, 2007 Memorandum <br />TDR Questionnaire <br />INFORMATION CONTACT: <br />Craig Benedict, Planning Director, 245 <br />2592 <br />Glenn Bowles, 245 2577 <br />PURPOSE: To identify BOCC preliminary positions on strategic elements of the County TDR <br />program and to give direction to staff and the consultant. <br />BACKGROUND: The BOCC retained The Louis Berger Group and the University of North <br />Carolina -Charlotte Urban Institute to complete Phase III of the TDR study. The Phase III <br />studies are a continuation of the first two phases (background data collection and feasibility), <br />which Berger and the Urban Institute completed in the fall of 2006. <br />Staff has continued to work with The Louis Berger Group since its contract was amended in <br />November 2006 to include Phase III work to define specific program and administrative design <br />issues. The Environment and Resource Conservation Department and the County Attorney <br />have been consulted on all aspects of these issues. <br />The consultant has identified several issues that touch on broader policy questions that the <br />BOCC can best give direction. The consultant is requesting that these work session <br />discussions help to frame these policy issues within the TDR program. Part of this discussion <br />will be the analysis of the TDR questionnaire, which was recently either faxed or emailed to <br />BOCC members. Ms. Vicky Bott with the Urban Institute (contact number - 704 687 2314) can <br />address any questions related to the questionnaire. Answers to general questions about the <br />overall TDR program are available on the Orange County TDR website at <br />www.co.orange.nc.us/Planning. <br />Informal results and discussions of the survey will be preliminarily folded into a conceptual <br />framework for TDR program and administrative design and ordinance text before any public <br />outreach discussions are scheduled. <br />FINANCIAL IMPACT: There is no financial impact associated with this item. <br />RECOMMENDATION: The Administration recommends that the Board discuss the strategic <br />elements of the County TDR program and provide direction to the consultant and staff on the <br />issues discussed. <br />
