DocuSign Envelope ID:91 F43AFA-8CB4-4861-887A-F304C7A6614B <br /> Executive Recruitment Expense <br /> We will reimburse necessary and reasonable extra expense incurred to recruit a person <br /> to replace the Chief Executive Officer or Executive Director of the "Organization" if the <br /> Chief Executive Officer or the Executive Director dies by accident during the policy <br /> period. Such extra expense includes amounts paid by the "Organization"for advertising, <br /> travel reimbursement, legal costs and executive search firm consulting fees. This <br /> additional coverage is subject to an annual aggregate of$50,000,which is the most we <br /> will pay for the sum of all recruitment expense claims under this policy. <br /> Abuse of Process <br /> Section V—Definitions, Paragraph 14.b. is replaced by the following: <br /> b. Malicious prosecution or abuse of process; <br /> Damage to Property of Others <br /> We will pay for damage to property of others when such damage is the result of an act <br /> committed by a client of the first Named Insured, and the property damaged is owned by <br /> someone other than the Named Insured or any of the Named Insured's clients, <br /> employees or volunteers. This additional coverage is subject to an occurrence limit of <br /> $5,000 for any act, and an annual aggregate of$25,000. <br /> III. ADDITIONAL DEFINITIONS <br /> "Certified Act of Terrorism" means an act that is certified by the Secretary of the Treasury, in <br /> concurrence with the Secretary of State and the Attorney General of the United States, to be <br /> an act of terrorism pursuant to the federal Terrorism Risk Insurance Act of 2002. <br /> "Extraordinary Travel Expense" means necessary and reasonable hotel expense incurred <br /> within 48 hours of a"Certified Act of Terrorism"that caused a"Member's" commercial train <br /> trip or airline flight to be cancelled, as well as the increased amount necessarily and <br /> reasonably incurred by the"Member" due to rescheduling train or airline transportation that <br /> was cancelled as a result of a"Certified Act of Terrorism". <br /> "Identity Theft" means fraudulent use of the social security number or other method of <br /> identifying a current"Member", except the"Organization", and includes fraudulently using <br /> the personal identity of the"Member"to establish credit, secure loans, enter into contracts or <br /> commit crimes. <br /> "Identity Theft Expense" means necessary and reasonable expense for: <br /> 1. Costs of re-filing applications for loans, grants or other credit instruments that are <br /> rejected solely as the result of an"Identity Theft"; <br /> 2. Costs of notarizing affidavits or other similar documents, long distance telephone <br /> calls and postage solely as a result of the"Member's" efforts to report an"Identity <br /> Theft" or amend or rectify records with respect to the"Member's"true name or <br /> identity as a result of an "Identity Theft". <br /> "Member" means the"Organization" and any natural person who was, is, or becomes duly <br /> elected a director or trustee,or duly elected or appointed officer,employee,committee <br /> member, volunteer, intern or student in training of the"Organization", solely in his or her <br /> capacities as such."Member"also means the spouse of a director, trustee,officer, <br /> employee, committee member, volunteer, intern or student in training for a claim arising <br /> solely out of his or her status as the spouse of a member. <br /> NPO-001 04 09 Page 4 of 5 <br />
