14 <br /> 1 Commissioner Jacobs said the point at which the State changed the law seems to be a <br /> 2 good cut off point. He said those who have wrongly paid the fee could be encouraged to <br /> 3 donate the fees to the County. <br /> 4 Commissioner Dorosin asked if the proposed amendment distinguishes between <br /> 5 massage therapists, who are licensed by the State, and massage businesses. <br /> 6 John Roberts said this amendment would apply to independent and stand-alone <br /> 7 businesses for massage therapy, and it no longer applies to the individual massage therapists. <br /> 8 Commissioner Price clarified that the change is being made from a privileged license to <br /> 9 a regulatory license and asked if there is a difference between the two. <br /> 10 John Roberts said one can get a privilege license, which allows one to do business in <br /> 11 the County whether one actually does business or not. He said a regulatory license is for one <br /> 12 conducting an activity in a part of the County where the County has authority. <br /> 13 Commissioner Price asked if this is similar to someone applying for site plan <br /> 14 development. <br /> 15 John Roberts said no, this is not like a planning permit. He said this is much less time <br /> 16 consuming. <br /> 17 Commissioner Price asked if this is akin to a processing fee. <br /> 18 John Roberts said yes, and he said it is a way to insure that businesses are being <br /> 19 operated legitimately. <br /> 20 <br /> 21 A motion was made by Commissioner Rich, seconded by Commissioner Pelissier for the <br /> 22 Board to adopt these massage business amendments into the Orange County Code of <br /> 23 Ordinances, authorize the Chair to sign the attached Resolution of Adoption, and authorize the <br /> 24 County Attorney to make any minor non-substantive changes or corrections that may be <br /> 25 necessary prior to submission of the amendment to Municode. <br /> 26 <br /> 27 Commissioner Jacobs added a stipulation that John Roberts and the tax office have a <br /> 28 reasonable amount of time to reimburse those who have wrongly paid fees over the years. <br /> 29 Both motion makers accepted this. <br /> 30 <br /> 31 VOTE: UNANIMOUS <br /> 32 <br /> 33 d. Efland Heirs and Approval <br /> 34 of Budget Amendment#9-A <br /> 35 The Board considered approval of a contract to purchase approximately 37 acres from <br /> 36 the S.L. Efland Heirs, LLC for an expansion of the County's Soccer.com Center in Efland, <br /> 37 approval of Budget Amendment#9-A and authorize the Chair to sign. <br /> 38 David Stancil, Department of Environment, Agriculture, Parks and Recreation (DEAPR) <br /> 39 Director, reviewed the background information, and showed some photographs via a <br /> 40 PowerPoint presentation. He gave some facts and figures of the current facility, noting it has <br /> 41 become a destination facility. <br /> 42 <br /> 43 The S.L. Efland Heirs, LLC owns approximately 37 acres located adjacent to Orange County's <br /> 44 Soccer.com Center on West Ten Road in Efland. The County was interested in acquiring the <br /> 45 property for an expansion of the soccer center facilities. Since the center opened in August <br /> 46 2009, there has been an increasing need for additional parking and playing fields; however <br /> 47 there is no available space for new facilities on the existing County property. <br /> 48 <br /> 49 <br /> 50 <br />
