(Required in'Copy'only,not in'Original'.) <br /> • Form CIQ — Conflict Of Interest Questionnaire: Chapter 176 of the Texas Local Government Code <br /> requires vendors and consultants contracting or seeking to contract with H-GAC to file a Conflict of <br /> Interest Questionnaire (CIQ) if they have an employment or other business relationship with an H-GAC <br /> officer or an officer's close family member. The required questionnaire is located at the Texas Ethics <br /> Commission website: http://www.ethics.state.tx.us/whatsnew/conflict_forms.htm. It is Bidder's <br /> responsibility to download the forth and furnish a completed copy with the Response,if it is applicable. <br /> n. By submittal of Response, Offeror certifies to the best of its knowledge that all information is true and correct. <br /> 28. CLARIFICATION TO SPECIFICATIONS&REQUIREMENTS <br /> a. If Offeror is in doubt as to the meaning of any item in this Invitation, a written request for clarification may be <br /> submitted to H-GAC up to fifteen (15) calendar days prior to the deadline for response submission. H-GAC <br /> shall not be responsible for late delivery. Requests may be transmitted by FAX or e-mail to the assigned <br /> Specification Specialist,and should clearly reference this Invitation number and the specific page and paragraph <br /> in question. If there are multiple questions, they should be stated separately and numbered. <br /> b. Any interpretation of Invitation documents, if made,will be by written Addendum duly issued. A copy of such <br /> Addendum will be mailed or delivered to each person officially on record as having been sent a copy of this <br /> Invitation. H-GAC will not be responsible for any other explanation or interpretation of the Invitation <br /> documents made or given prior to the award of the contract. <br /> c. Any objections to the Invitation documents must be filed in writing with H-GAC on or before fifteen (15) <br /> calendar days prior to the deadline for submission of responses. <br /> d. Prospective offerors are advised that, after a draft specification has been issued, the Pre-Bid/Proposal <br /> Conference is the primary forum through which comments and suggestions may be offered for consideration by <br /> H-GAC prior to issuance of the final invitation and specifications. <br /> e. All best efforts have been made to insure that the product/service descriptions and associated specification <br /> information in Sections B & C are correct, and adequate time has been given to prospective Offerors to point <br /> out mistakes. However,if an error remains and is caught by Offeror before the scheduled bid/proposal opening, <br /> Offeror shall make note of the required correction in the Response, and shall also notify H-GAC prior to the <br /> opening of responses. <br /> 29. INCONSISTENT INFORMATION <br /> H-GAC review of responses supplied on H-GAC FORMS is a significant part of the evaluation process. Offeror <br /> shall state clearly all information required on the FORMS. Offeror's information supplied on the FORMS shall take <br /> precedence in the event any standard"boilerplate"type language included in Offeror's response is inconsistent with <br /> the information supplied by Offeror on the H-GAC FORMS. In all cases, information on H-GAC's printed <br /> FORMS supplied as part of Offeror's response shall take precedence over information supplied on electronic media. <br /> 30. REJECTION OF RESPONSES <br /> a. H-GAC may reject a response if: <br /> • Offeror misstates or conceals any material fact in the Response,or if, <br /> • Offeror does not strictly conform to law or the requirements of this Invitation. <br /> b. H-GAC may reject any and all responses, and may reject any part of a response. <br /> c. H-GAC, at it's sole discretion, may also waive any formalities or irregularities in any response, or ask for <br /> corrected information except for pricing. <br /> 31. WITHDRAWAL OR MODIFICATION OF RESPONSES <br /> Once received by H-GAC, responses may be modified or withdrawn prior to the submission deadline only if the <br /> request to do so is in writing submitted by Offeror's authorized representative. Responses and requests for <br /> modification received after the submission deadline will not be accepted. Requests for response withdrawal <br /> Revised: 12/03/09 Page 13 of 19 <br />
