Whereas the County has been designated by HGACBUY as an "End User" identified in <br /> Contract No. AM10-14 and is thus permitted to enter into an End User Agreement with <br /> Contractor to procure the goods and services offered under the same terms or terms that <br /> exceed the terms of Contract No. AM10-14 ; and <br /> H. Whereas the County desires to contract with Contractor for supplies or services identical, <br /> or nearly identical, to the supplies or services Contractor is providing other units of <br /> government under Contract No. AM10-14 and Contractor consents to the County's <br /> utilization of the Contract No. AM10-14 as the basis of this Agreement and desires to <br /> enter into this Agreement with County to provide the supplies and services set forth in the <br /> Agreement. <br /> AGREEMENT <br /> NOW, THEREFORE, in consideration of the foregoing recitals, which are incorporated by <br /> reference, and the covenants and promises contained in this Linking Agreement, the Parties <br /> agree as follows: <br /> 1. Duration of Services. <br /> a. Term. The County is purchasing the supplies and/or services from the Contractor <br /> pursuant to Contract No. AM10-14. According to Contract No. AM10-14 purchases can <br /> be made by governmental entities from the date of award, which was October 1, 2014 <br /> until the date the contract expires on September 30, 2016, unless the term of the Contract <br /> No. AM10-14 is extended by the mutual agreement of the original contracting parties. <br /> Contract No. AM10-14, however, may not be extended the contract beyond September <br /> 30, 2016. The Effective Date of this Agreement is the date the last party executes this <br /> Agreement prior to September 30, 2016. <br /> b. Scheduling of Services <br /> i) The Provider shall schedule and perform its activities in a timely manner so as to <br /> meet the time period listed in Section 4.a.ii below. <br /> ii) Should the County determine that the Provider is behind schedule, it may request <br /> the Provider to expedite and accelerate its efforts, including providing additional <br /> resources and working overtime, as necessary, to perform its services in <br /> accordance with the approved project schedule at no additional cost to the <br /> County. <br /> iii) The Commencement Date for the Provider's Basic Services shall be Upon <br /> Execution of the Agreement. <br /> 2 <br /> Revised March 23,2016 <br />
