CONFIDENTIAL/PROPRIETARY MATERIALS <br /> All documentation submitted as part of Offeror's response to this Invitation will be considered to be in the public <br /> domain and may be made available to Members and others, after contract award, upon properly submitted request. If <br /> Offeror submits documents marked"confidential"or"proprietary',the Response may be deemed non-compliant. <br /> 9. REFERENCES <br /> a. Offeror shall list the names of at least five government agencies within the continental United States which <br /> have purchased from Offeror products or services similar to those covered by this Invitation,within the last two <br /> years. H-GAC reserves the right to determine if such products or services are appropriately similar. <br /> b. Offeror may provide reference information in whatever format desired, but each should include the following <br /> specific information: <br /> • Agency name <br /> • Contact person name <br /> • Address <br /> • Phone&Fax numbers <br /> • Description of product(s)or service(s)and date sold <br /> c. Other information,including criticism however learned,may be used by H-GAC in evaluation of responses. <br /> 10. INSURANCE <br /> a. Unless otherwise stipulated in Section B, Offeror/Contractor must have the following insurance and coverage <br /> minimums: <br /> General liability insurance with a Single Occurrence limit of at least$1,000,000.00, and a General Aggregate <br /> limit of at least two times the Single Occurrence limit. <br /> Product liability insurance with a Single Occurrence limit of at least $1,000,000.00, and a General Aggregate <br /> limit of at least two times the Single Occurrence limit for all Products except Automotive Fire Apparatus. For <br /> Automotive Fire Apparatus, see Section B—Product Specific of this Invitation. <br /> Property Damage or Destruction insurance is required for coverage of End User owned equipment while in <br /> Contractor's possession, custody or control. The minimum Single Occurrence limit is $500,000.00 and the <br /> General Aggregate limit must be at least two times the Single Occurrence limit. This insurance may be carried <br /> in several ways,e.g.under an Inland Marine policy, as part of Automobile coverage, or under a Garage Keepers <br /> policy. In any event, this coverage must be specifically and clearly listed on insurance certificate(s) submitted <br /> to H-GAC. <br /> b. Insurance coverage shall be in effect for the length of any contract made pursuant to this Invitation, and for any <br /> extensions thereof, plus the number of days/months required to deliver any outstanding order after the close of <br /> the contract period. <br /> c. Original Insurance Certificates must be furnished to H-GAC on request, showing Offeror/Contractor as the <br /> insured and showing coverage and limits for the insurances listed above. <br /> d. If any Product(s) or Service(s) will be provided by parties other than Offeror/Contractor, all such parties are <br /> required to carry the minimum insurance coverages specified herein, and if requested by H-GAC, a separate <br /> insurance certificate must be submitted for each such party. <br /> e. H-GAC reserves the right to contact insurance underwriters to confirm policy and certificate issuance and <br /> document accuracy. <br /> 11. OFFEROR CERTIFICATIONS <br /> Offeror,by submission of a Response hereto, makes the following certifications under penalty of perjury and <br /> possible contract termination if any of these certifications are found to be false. <br /> Non-Collusive Response <br /> a. The prices in the Response have been arrived at independently without collusion, consultation, communication, <br /> or agreement for the purpose of restricting competition, as to any matter relating to such prices with any other <br /> Offeror or potential competitor. <br /> Revised: 12/03/09 Page 6 of 19 <br />
