A Recognized <br /> Environmental Condition(REC) is defined by ASTM Standard Practice E1527-13 as the presence or <br /> likely presence of any hazardous substances or petroleum products in, on, or at a property: (1) due to <br /> release to the environment; (2)under conditions indicative of a release to the environment; or(3)under <br /> conditions that pose a material threat of a future release to the environment. Recognized environmental <br /> conditions are not intended to include de minimis conditions. A de minimis condition is defined as a <br /> condition that generally does not present a threat to human health or the environment and that generally <br /> would not be the subject of an enforcement action if brought to the attention of appropriate government <br /> agencies. <br /> Phase I ESA's, in conjunction with Phase 11 assessments (where necessary), are intended to permit a user <br /> to satisfy one of the requirements to qualify for the innocent landowner defense to CERCLA liability; that <br /> is, the practices that constitute "all appropriate inquiries into the previous ownership and uses of the <br /> property consistent with good commercial or customary practice" as defined in 42 USC §9601(35)(B). <br /> The Phase I ESA will be conducted in general accordance with ASTM Standard E1527-13. <br /> Additional investigation(s), outside of the scope of the Phase I ESA proposed herein, may also be <br /> required, based on the findings of the Phase I ESA. <br /> Procedure <br /> The level of inquiry may vary from site to site, based on the site conditions and judgment of the assigned <br /> environmental professional.
