2 <br /> County. In 2014 the subdivision was added to Chapel Hill's Extraterritorial Zoning Jurisdiction <br /> (ETJ) and rezoned to the Town's Residential-1 zoning district. Subdivisions within the JPA <br /> and/or the ETJ are not required by law to be annexed by the town, and the Town has indicated <br /> that it is not pursuing annexation for this area at this time. <br /> Public sewer was extended from the southwest at the time of development to provide service to <br /> its residents. Thus the subdivision is not included in the current efforts to provide sewer to a <br /> number of properties in the Rogers Road area. Communications with Chapel Hill Planning staff <br /> indicate that there are no known subdivision violations. <br /> The final plat for the subdivision was recorded on November 20, 2009 (Attachment 2). Phoenix <br /> Drive, Edgar Street, Lizzie Lane, and Gracie Circle were designed to public road standards but <br /> have been private roads in the interim, intended to become a public roads when conditions met <br /> NCDOT maintenance responsibility and ownership criteria. <br /> A total of .49 mile of roads in the subdivision, providing access for 48 lots, is being petitioned for <br /> addition to the State Maintained Secondary Road System. Three of the roads have a right-of- <br /> way width of 50 feet, and a pavement width of 22 feet; one road (Edgar Street) has a right-of- <br /> way width of 60 feet, and a pavement width of 22 feet. These roads have been stubbed out for <br /> connectivity to undeveloped land. <br /> NCDOT has investigated this request and has submitted a petition to the Board of County <br /> Commissioners (BOCC) for its recommendation (Attachment 3). North Carolina General Statute <br /> §136-62 requires that road petitions for additions to the state system be made by the Board of <br /> County Commissioners (BOCC). <br /> Conclusion <br /> The above-referenced application meets the criteria endorsed by the BOCC for recommending <br /> acceptance of public roads into the State Maintained System for roads approved through the <br /> governing jurisdiction's subdivision process (NCDOT Subdivision Roads Minimum Construction <br /> Standards, January 2010). <br /> FINANCIAL IMPACT: There is no direct financial impact to the County associated with this <br /> item. NCDOT will incur additional maintenance responsibilities and costs. <br /> SOCIAL JUSTICE IMPACT: The following Orange County Social Justice Goal is associated <br /> with this item: <br /> GOAL: CREATE A SAFE COMMUNITY <br /> The reduction of risks from vehicle/traffic accidents, childhood and senior injuries, gang <br /> activity, substance abuse and domestic violence. <br /> The addition of private residential streets to the State Maintained Secondary Road System <br /> results in positive outcomes related to the aforementioned goal. <br /> RECOMMENDATION(S): The Manager recommends that the Board: <br /> 1. Forward the Petition for Addition to the State Maintained System to the NCDOT for Phoenix <br /> Drive, Edgar Street, Lizzie Lane, and Gracie Circle in Phoenix Place Subdivision; and <br /> 2. Recommend the Department of Transportation accept the roads for maintenance as State <br /> Secondary Roads. <br />
