ORANGE COUNTY <br />BOARD OF COMMISSIONERS <br />ACTION AGENDA ITEM ABSTRACT <br />Meeting Date: September 19, 2007 <br />Action Agenda <br />Item No. ~U -'G <br />SUBJECT: Contract Award, Agreement for Construction Manager at Risk Services, Central <br />Orange Senior Center and Sportsplex Renovation <br />DEPARTMENT: Purchasing PUBLIC HEARING: (Y/N) No <br />ATTACHMENT(S): INFORMATION CONTACT: <br />Pam Jones, (919) 245-2652 <br />Agreement (Available for Review in the Geof Gledhill (919) 732-1096 <br />Clerk's Office)' Jeff Thompson (919) 245-2650 <br />PURPOSE: To consider approval of an Agreement for Construction Manager at Risk <br />Services, ("Agreement") with Resolute Building Company as Orange County's Construction <br />Manager at Risk ("CMAR")for the construction of the Central Orange Senior Center and <br />Sportsplex Renovation. <br />BACKGROUND: On November 14, 2006, the Board approved this project for CMAR <br />contracting and exempted this project from the qualifications based selection process for <br />Architects and Construction Managers at Risk as provided in G.S. 143-64-32. On.March 13, <br />2007, the Board approved the project scope and final design for the Central Orange Senior <br />Center, the Adult Day Health Center and the renovations within the Sportsplex to allow for more <br />efficient operational space. The Board also approved Resolute Building Company as the <br />County's CMAR, thereby allowing them to solicit bids in anticipation of a final Guaranteed <br />Maximum Price for Board approval. <br />Since the March meeting, the Project Team consisting. of Corley, Redfoot, Zack (CRZ), <br />Resolute Building Company (RBC), Recreation Factory Partners (RFP), the County Attorney, <br />the County's contract Construction Manager and County Staff have worked through two bid <br />offerings, conducted iterative value engineering exercises and have arrived at the Guaranteed <br />Maximum Price reflected in the Agreement: The team has also arrived at a cogent CMAR <br />Contract Document between RBC and the County. <br />The project will begin soon after approval of the Agreement contract by the Commissioners, with <br />scheduled completion approximately 63 weeks thereafter. <br />FINANCIAL IMPACT: The Guaranteed Maximum Price ("GMP") for this project is $5,253,334. <br />This GMP includes a 3.5% contingency that represents the CMAR's level of risk assumed within <br />the GMP. If the contingency is not used, those funds are not disbursed to the CMAR. Funding <br />for this project in an amount sufficient to support the GMP contract was approved in the <br />2007-2017 Capital Investment Plan. <br />RECOMMENDATION(S): The Manager recommends that the Board approve the Agreement; <br />authorize the Chair to sign on behalf of the Board; and authorize the Manager or her designate <br />to execute and report to the Board any future change orders within the project budget as may be <br />appropriate. <br />
