4 <br /> ORANGE COUNTY <br /> NOR C-1R0I.I N <br /> A. Personal Conflicts of Interest. No employee, officer, agent, transit services <br /> board member, County Commissioner or his or her immediate family <br /> member, partner, or organization that employs or is about to employ any of <br /> the foregoing individuals may participate in the selection, award, or <br /> administration of a contract funded by FTA if a conflict of interest, real or <br /> apparent, would be involved. Such a conflict would arise when any of those <br /> individuals previously listed has a financial or other interest in the firm <br /> selected for award. <br /> B. Gifts. OPT's officers, employees, agents, transit services board members, or <br /> County Commissioners may neither solicit nor accept gifts, gratuities, favors, <br /> or anything of monetary value from contractors, potential contractors, or <br /> parties to sub-agreements. OPT has set minimum rules for acceptance of <br /> gifts: <br /> 1. Acceptance of any gift: Acceptance of any gift, favor, or service from any <br /> individual(s) interested in any business relationship with OPT, which would <br /> cause a reasonable person to question the officer's or employee's <br /> impartiality in the matter, is considered to be a conflict of interest (except <br /> those donated for a specific activity or purpose sanctioned by Orange <br /> County or OPT). <br /> 2. Acceptance of any personal gift: Acceptance of any personal gift, favor, <br /> service or item, regardless of value, from an individual(s) for the <br /> employee's own economic benefit or as a trade for any OPT services (i.e., <br /> advertising space, etc.) is considered to be a conflict of interest. <br /> 3. Acceptance of gifts from any source so frequent as to raise an <br /> appearance of the use of the employee's position for private gain is <br /> considered to be a conflict of interest. <br /> C. Violations. To the extent permitted by the State of North Carolina, local law <br /> or regulations, penalties, sanctions, or other disciplinary action for violation of <br /> these standards up to and including termination shall apply. <br /> D. Conflicts of Interest Certification. On an annual basis, OPT requires all <br /> employees who participate in the procurement process to sign a certification <br /> that they have read, understand, and will comply with OPT's Conflict of <br /> Interest Policy. <br /> 2 <br />
