Use of Existing Contracts <br /> In many cases, OPT will use existing contracts between the North Carolina <br /> Department of Transportation — Public Transportation Division and vendors <br /> that supply capital items of interest to OPT in its functional operation. Any <br /> purchase from NCDOT's contracts requires that the contract include all FTA <br /> terms and conditions (contract clauses and required vendor certifications). <br /> The use of a State contract that is not the result of a competitive process <br /> does not meet the FTA requirement for competition. In many cases, these <br /> procurements will be considered joint acquisitions rather than examples of <br /> "piggybacking." <br /> VI. PROTESTS AND DISPUTES <br /> A. Protests <br /> Any interested party wishing to protest a matter involving a proposed <br /> procurement or contract award must submit a written protest to the OPT <br /> Administrator. <br /> 1. Submittal Procedures: The protest must be addressed to the OPT <br /> Administrator and must include the following information: <br /> a. Name, address, telephone number, fax number and email of the <br /> protestor; <br /> b. Signature of the protestor or authorized agent; <br /> c. The bid name and number; <br /> d. A detailed statement of the legal and factual grounds of the protest <br /> including copies of relevant documents; <br /> e. Any supporting exhibits, evidence, or documents to substantiate any <br /> claims; and <br /> f. The form of relief requested. <br /> If the procurement uses Federal funds, an informal notice of receipt of a <br /> protest must be given to the appropriate regional office of the Federal <br /> Transit Administration (FTA). The form of notice may be specified by the <br /> regional office. <br /> 17 <br />
