Animal Control Ordinance <br /> Number of Prior Amount <br /> Nuisance Violations <br /> 1 $100.00 <br /> 2 $200.00 <br /> 3 or more $400.00 <br /> (2) This civil penalty shall be paid to the Animal Services Director or his or her <br /> designee within 14 days of receipt. This civil penalty is in addition to any other <br /> fees, taxes, costs or fines imposed that are authorized by this Ordinance. <br /> (3) In the event that the applicable civil penalty is not paid within the time period <br /> prescribed, a civil action may be commenced to recover the penalty and costs <br /> associated with collection of the penalty, and/or a criminal summons may be <br /> issued against the Owner or Keeper or other alleged violator of this Ordinance, <br /> and upon conviction, the Owner or Keeper shall be punished as provided by State <br /> law. Failure on the part of the Owner or Keeper of an animal or other alleged <br /> violator to pay the applicable civil penalty within the time period prescribed is <br /> unlawful and a violation of the Ordinance. Appeals„„ <br /> Except as otherwise provided herein any appeals provided by this Chapter shall be to a three <br /> member hearing panel as follows: <br /> (a) A person who has been found to be in violation of this Chapter may appeal the final <br /> decision made by the Animal Services Director to the appeal board by filing a notice <br /> of appeal containing a concise statement of the reason for the appeal and delivering it <br /> to the Animal Services Director within five (5) days of receipt of the final decision. <br /> (b) A hearing shall be scheduled within ten (10) days of the receipt of notice of appeal. <br /> (c) A party alleged to be in violation of this Chapter may be represented by an <br /> individual of their choosing, including an attorney. <br /> Adopted 1/21/2016 Unified Animal Control Ordinance Page 27 <br /> Effective 3/1/2016 <br />
