4 <br />5. The flood plain and the 65-foot stream buffers associated with the streams must be <br />shown on the Preliminary Plan. <br />6. Show location of subdivision sign on Preliminary Plan and reserve an easement for the <br />sign. <br />7. Any lighting shall meet Orange County Lighting Standards. <br />• Third Action: Preliminary Plan Approved on July 11, 2007 by the Planning Board with the <br />recommendation that the road not be stubbed to the eastern property line. Vote 8 to 1. <br />COMMENTS FROM THE JULY 11, 2007 PLANNING BOARD MEETING <br />1. The Planning Board discussed RPAC's recommendation that an acre be dedicated to <br />the County and considered that against the proposed .59-acre dedication. While the <br />.59-acre dedication proposed by the developer meets the requirements of the <br />Subdivision Regulations and the Zoning Ordinance, the Planning Board voted to <br />accept the RPAC and ERCD recommendations. <br />2. The Planning Board then discussed the applicant's proposal for reservation of land for <br />a future road stub to the eastern property line. The plan shows a 50-foot wide section <br />of land extending to the eastern property line, but it would remain under HOA <br />ownership until such time as the land would be needed for the road's extension. <br />The developer's representative, Steve Yuhasz, stated as found on page 25 from the <br />Planning Board minutes, "Our original proposal was to have the road to the adjoining <br />property. In meetings with the property owner, they asked that we not do that. They <br />have no plan to develop it. If there were a road to their property there would be more <br />pressure to develop it. I would prefer to see a reservation versus an actual dedication <br />and keep the 50 foot strip, as part of the Homeowners Association." <br />The County asks that the stub be dedicated to the County for ease of future <br />connection. Ownership of the stub by the HOA could cause complications in the <br />future. The Planning Board, after considering the applicant's proposal and the <br />County's request, approved the subdivision without any road stub. <br />• Fourth Action: The County Board of Commissioners considers approval of the preliminary <br />plan. <br />FINANCIAL IMPACT: The Fiscal Impact Analysis is not prepared for a subdivision with less <br />than 10 lots. <br />RECOMMENDATION(S): The Administration recommends Approval of the Preliminary Plan <br />in accordance with the attached Resolution of Approval with the <br />stipulations: <br />• The applicant offers to dedicate .89 acres as shown on the <br />attached map (Page 36). If the applicant chooses not to dedicate <br />the suggested .89 acres, then the Administration recommends <br />that the BOCC refer the subdivision back to the Planning Board <br />for further discussion. <br />• That the 50-foot width road stub be dedicated to the County via <br />fee-simple with a deed (B.8 on the Resolution). <br />
