1 <br /> ORANGE COUNTY <br /> BOARD OF COMMISSIONERS <br /> ACTION AGENDA ITEM ABSTRACT <br /> Meeting Date: April 5, 2016 <br /> Action Agenda <br /> Item No. 6-h <br /> SUBJECT: License Agreement Renewal — Eno River Farmers' Market, Inc. <br /> DEPARTMENT: Environment, Agriculture, <br /> Parks and Recreation <br /> (DEAPR) <br /> ATTACHMENT(S): INFORMATION CONTACT: <br /> Proposed License Agreement and David Stancil, 245-2510 <br /> Attachments Lori Taft, 245-2660 <br /> PURPOSE: To consider approving a renewed license agreement for the Eno River Farmers' <br /> Market, Inc., for use of the Farmers' Market Pavilion from April 1, 2016 through March 31, 2019. <br /> BACKGROUND: On May 5, 2009 Orange County entered into a license agreement with the <br /> Eno River Farmers' Market, Inc. (ERFM), for use of the Farmers' Market Pavilion. The Pavilion <br /> is located within the County's River Park and is just south of East Margaret Lane behind the <br /> Orange County District Attorney's office. <br /> On March 13, 2012 Orange County and the ERFM agreed to a one-year amendment of this <br /> agreement, and on March 7, 2013, the two parties agreed to a three-year agreement which <br /> expires this year (March 31, 2016). Arrangements were made for the market to operate on April <br /> 2, 2016. <br /> A renewal license agreement (attached) continues the $300 annual rate agreed to in 2013 for an <br /> additional three years. The attached agreement eliminates the clause in Section One (A) that <br /> precluded use of the Pavilion for one Saturday every three years for the Orange County Egg <br /> Hunt. The Egg Hunt will be moved so as not to interfere with the ERFM Saturday schedule. <br /> The potential return of Hog Day is addressed in the same paragraph within a framework of <br /> mutual cooperation between the two entities. Section One (C) adds a provision for "unusual <br /> maintenance". Otherwise, there are no substantive changes to the 2013 license agreement. <br /> FINANCIAL IMPACT: There is no financial impact associated with this license agreement. The <br /> same flat rate of $300 per year that was approved by the Board in 2013 is continued. The per <br /> diem rate for this facility is $10/day. <br /> SOCIAL JUSTICE IMPACT: The following Orange County Social Justice Goal is applicable to <br /> this agenda item: <br /> • GOAL: ENSURE ECONOMIC SELF-SUFFICIENCY <br /> The creation and preservation of infrastructure, policies, programs and funding necessary <br /> for residents to provide shelter, food, clothing and medical care for themselves and their <br /> dependents. <br />
