2 <br /> Curtis, has determined extending Beaver Valley Drive to serve the undeveloped phase of the <br /> project, is not currently viable given the costs associated with extending the roadway in <br /> accordance with applicable NC DOT/flood regulatory guidelines and additional negative <br /> environmental impacts would be created in the area. <br /> Mr. Curtis is proposing to amend the project by terminating Beaver Valley Drive as a cul-de-sac <br /> near lots 37 through 39. As proposed the area formerly encumbered by the right-of-way would <br /> be combined with adjacent open space parcel(s). Please refer to Attachment 4 for additional <br /> detail. <br /> In reviewing the request staff has the following comment(s): <br /> 1. Staff agrees extension of Beaver Valley Drive will be complicated due to the presence of <br /> floodplain along the stream. <br /> 2. There is concern about the total elimination of all potential future connectivity to what was <br /> designated as `Beaver Valley Phase 2' with the wholesale elimination of the <br /> aforementioned right-of-way. <br /> 3. Staff recommends the applicant be allowed to amend the plat and create a cul-de-sac as <br /> proposed, but require the right-of-way to be preserved. This would preserve the ability for <br /> Beaver Valley Drive to be extended in the future if necessary to ensure connectivity. <br /> STAFF COMMENT: There is potential access to Phase 2 of the original project <br /> via Hoover Road, but connectivity is not guaranteed. <br /> FINANCIAL IMPACT: Existing staff will complete the necessary work required for this project. <br /> Adoption of the proposed revision is not expected to cause significant financial impacts <br /> (negative or positive) with respect to this project. <br /> SOCIAL JUSTICE IMPACT: The following Social Justice goal(s) are applicable to this item: <br /> • GOAL: CREATE A SAFE COMMUNITY <br /> The reduction of risks from vehicle/traffic accidents, childhood and senior <br /> injuries, gang activity, substance abuse and domestic violence. <br /> • GOAL: ESTABLISH SUSTAINABLE AND EQUITABLE LAND-USE AND <br /> ENVIRONMENTAL POLICIES <br /> The fair treatment and meaningful involvement of people of all races, cultures, <br /> incomes and educational levels with respect to the development and <br /> enforcement of environmental laws, regulations, policies, and decisions. Fair <br /> treatment means that no group of people should bear a disproportionate share <br /> of the negative environmental consequences resulting from industrial, <br /> governmental and commercial operations or policies. <br /> RECOMMENDATION(S): The Manager recommends that the Board approve the proposed <br /> revision, specifically allowing for the creation of the cul-de-sac while preserving a `paper' right- <br /> of-way for possible future connectivity, consistent with staffs recommendation. <br />
