2 <br /> Governors Grove Subdivision <br /> Governors Grove Subdivision is located off of Governor Scott Road in the northwest part of the <br /> county, east of Mill Creek Road and west of Efland-Cedar Creek Road, in Cedar Grove <br /> Township (Attachment 1). The major subdivision, originally approved in 1992, is in Orange <br /> County's zoning and subdivision jurisdiction. There are multiple phases to the project and, as a <br /> result, multiple final plats. There are seven (7) final plats have been recorded for the <br /> subdivision, one for each phase of the subdivision. The final plats were recorded between <br /> October 4, 1994 and May 12, 1997 (Attachment 2). <br /> The roads in Governors Grove Subdivision were designed to public road standards, but have <br /> been private roads in the interim, intended to be public roads when conditions met NCDOT <br /> maintenance responsibility and ownership criteria. <br /> A total of 1.48 miles of roads in the subdivision, providing access for 75 lots, is being petitioned <br /> for addition to the State Maintained Secondary Road System. All roads have a right-of-way <br /> width of 50 feet, and a pavement width ranging from 18 to 20 feet. <br /> NCDOT will use funding in the amount of $20,700 to perform minimal repairs on these roads as <br /> provided for in Senate Bill 119, Session Law 2015-264, Section 29.17E.(d), which established <br /> and funded a pilot program to improve paved or unpaved roads that are open to the public, but <br /> are not currently part of the State system. The subject roads were selected based on local <br /> knowledge of historical requests for maintenance and/or addition to the State system, <br /> connectivity to the State system and desirable cost/benefit with regard to number of homes <br /> served. <br /> Inspection of roads in the Governors Grove Subdivision revealed pavement and vegetation <br /> deficiencies (relating to ditch grades and right-of-way encroachments). Completion of these <br /> repairs by NCDOT will result in the roads being eligible for addition to the State highway system, <br /> with all other requirements having been previously met. NCDOT has requested that Orange <br /> County expedite this application so that it can meet the deadline for the next North Carolina <br /> Board of Transportation (NC BOT) meeting, and schedule the disbursement of the funds for this <br /> project. <br /> NCDOT has investigated this request and has submitted a petition to the Board of County <br /> Commissioners (BOCC) for its recommendation (Attachment 3). North Carolina General Statute <br /> §136-62 requires that road petitions for additions to the state system be made by the Board of <br /> County Commissioners (BOCC). <br /> Conclusion <br /> The above-referenced application meets the criteria endorsed by the BOCC for recommending <br /> acceptance of public roads into the State Maintained System for roads approved through the <br /> governing jurisdiction's subdivision process (NCDOT Subdivision Roads Minimum Construction <br /> Standards, January 2010). <br /> FINANCIAL IMPACT: There is no direct financial impact to the County associated with this <br /> item.
