It is mutually agreed between the parties as follows: 1. Ephesus Elementary School agrees to present the following performances: 8:15 and Thursday, October 22 9:45 AM Red Herring Puppets: ELECTRICITY! 1200 8:15 and Wednesday, January 6 9:45 AM Didgeridoo Down Under 1550 8:15 and Friday, February 26 9:45 AM Meet Dr. Kin both shows 1150 2. Ephesus Elementary School will pay The ArtsCenter the designated sums on or before the dates of each performance: • $1200 on or before Thursday, October 22nd, 2015 • $1550 on or before Wednesday, January 6th, 2015 • $1150 on or before Friday, February 26th, 2016 3. In the case of inclement weather, or any other act of God beyond either party's control which does or would significantly impact the ability of either party to perform or present under this contract, every attempt will be made to reschedule to the first date convenient to all parties. Should all parties fail to establish a date to reschedule, the above-stated obligations will be cancelled and neither party shall be able to make a claim for damages or breach of contract. 4. Cancellations of any performances must be made by August 31, 2015. Ephesus Elementary School will be responsible for payment for any shows cancelled after this date. 5. If Ephesus Elementary School wishes to switch their performance date or time with a partnering school because of a scheduling conflict, it is the responsibility of Ephesus Elementary School to find a school willing to switch.
