ORANGE COUNTY <br />BOARD OF COMMISSIONERS <br />ACTION AGENDA ITEM ABSTRACT <br />Meeting Date: August 21, 2007 <br />Action Agenda <br />Item No. ~ ~' <br />SUBJECT: Personnel Ordinance Amendment: Repeal of Previous Article IV, Section 1.0 <br />Worker's Compensation Leave <br />DEPARTMENT: Personnel/County Attorney PUBLIC HEARING: (Y/N) No <br />ATTACHMENT(S): INFORMATION CONTACT: <br />None Rod Visser, Acting Personnel Director, <br />919-245-2552 <br />Annette Moore, Policy and Compliance <br />Officer, 919-245-2317 <br />Geof Gledhill, County Attorney, <br />919-732-2196 <br />PURPOSE: To approve the repeal of the previously existing Article IV, Section 1.0 Worker's <br />Compensation Leave of the Orange County Personnel Ordinance and replacement with the <br />revised Article IV, Section 1.0 adopted June 26, 2007. <br />BACKGROUND: At the June 26, 2007 Board of County Commissioners meeting, the Board <br />unanimously approved the new Section 1.0 of Article IV of the Personnel Ordinance regarding <br />worker's compensation as follows: <br />1.0 Worker's Compensation Leave <br />In accordance with the provisions of the North Carolina Workers' Compensation Act, <br />Orange County will provide for employees protected under the Act who by accident suffer <br />personal injury or occupational disease arising out of and in the course of their . <br />employment with the County. (See NCGS 97-1, et. seq., The North Carolina Workers' <br />Compensation Act) The County Manager will promulgate rules and regulations <br />consistent with the North Carolina Worker's Compensation Act necessary to carry out the <br />provisions of this Article. <br />The action by the Board, however, did. not specifically address the disposition of the existing <br />Section 1.0 of Article IV. To make the Board's action clear, staff and the Attorney recommend <br />that the Board repeal the previously existing Article IV, Section 1.0 and replace it with the <br />language of the new Section 1.0 that the Board voted to approve on June 26, 2007. <br />FINANCIAL IMPACT: Funding for Orange County worker's compensation premiums for 2007- <br />08 was included in the approved budget at just over $1 million. However, the action approved <br />by the BOCC on June 26, 2007, and subsequent direction from the County Manager conforming <br />Orange County's worker's compensation procedures to comport with "best practices", are <br />expected to lead to savings in future fiscal year premiums. <br />
