This represents one component of a larger <br /> 3 discussion related to reducing development costs in an effort to promote affordable housing <br /> 4 development. <br /> 5 <br /> 6 February 18, 2016 <br /> 7 AGENDA ITEM: E-1 <br /> 8 WORK SESSION: <br /> 9 Review of Minimum Lot Size and Density Allowances for Subdivisions <br /> 10 <br /> 11 What is a Subdivision: <br /> 12 • All divisions of a parcel of land into two or more lots for immediate or future <br /> 13 sale/development, <br /> 14 • Includes division of land involving dedication/change in existing streets. <br /> 15 • Terms `subdivision' (i.e. process of creating lots) and `development' have become <br /> 16 synonymous. They do not necessarily mean the same thing (i.e. just because you are <br /> 17 subdividing does not mean you are engaged in development). <br /> 18 <br /> 19 Subdivision Classification(s) <br /> 20 • Exempt (i.e. State law indicates not a regulated activity) includes: <br /> 21 - Recombination of previously subdivided property (number of lots are not <br /> 22 increased), <br /> 23 - Creation of parcels in excess of 10 acres in area, <br /> 24 o STAFF NOTE: there have been issues with property owners coming back to <br /> 25 subdivide these 10 acre parcels as they have to bring lots/roadways into <br /> 26 compliance with UDO. <br /> 27 - Public acquisition by purchase of strips of land for widening or opening streets, <br /> 28 - Division of a tract of land in single ownership where the property is no greater <br /> 29 than 2 acres in area into not more than 3 lots if no street right-of-way dedication <br /> 30 is involved and resultant lots are equal to or exceed County regulations (i.e. <br /> 31 minimum lot area and width, etc.). <br /> 32 <br /> 33 Commissioner Dorosin asked if subdivision regulations apply, even when it is less than <br /> 34 three lots in the subdivision. <br /> 35 Michael Harvey said no, the property can be no greater than two acres for the last <br /> 36 exemption. <br /> 37 Michael Harvey resumed the presentation: <br /> 38 <br /> 39 • Minor: <br /> 40 - Division proposing 1 to 5 individual parcels, <br /> 41 - Reviewed and acted upon by staff. No board review (i.e. BOCC or Planning <br /> 42 Board) required. <br /> 43 • Major: <br /> 44 - Division proposing 6 or more individual parcels, <br /> 45 - Typically Planning Board approves a concept plan/makes recommendation on <br /> 46 preliminary plat application. BOCC makes final decision, <br /> 47 - Required review process related to number of proposed lots. <br /> 48 Major Subdivision can be processed as Class A Special Use Permit or Conditional Use <br /> 49 Rezoning based on number of proposed lots and location in County (i.e. rural versus <br /> 50 urban areas). <br /> 51 <br />
