HAKAN/CORLEY COMMENTS: 8/4/94 <br /> RENOVATIONS TO ORANGE COUNTY SHERIFF'S OFFICES <br /> Hillsborough, NC <br /> Project #9315 <br /> EXHIBIT "A" <br /> MODIFICATIONS OF THE STANDARD AIR CONTRACT DOCUMENT B141 <br /> THE FOLLOWING SECTIONS ARE MODIFIED TO READ: <br /> Article 2, paragraph 2 .4 . 2 : The Architect, after consultation <br /> with Owner, shall prepare the necessary bidding information and <br /> bid forms to comply with public building laws as set forth in <br /> North Carolina General Statutes Chapter 143, including the <br /> necessary information required by Chapter 87 of the North <br /> Carolina General Statutes pertaining to the licensing of <br /> contractors, and shall assist the Owner in the preparation of the <br /> conditions of the contract and the form of the agreement <br /> between the Owner and the General and Prime Contractors . <br /> Add as Article 2, paragraph 2. 5.2: In the event the lowest <br /> responsible bids exceed the funds appropriated for the project, <br /> the Architect, in consultation with, and at the direction of, the <br /> Owner, shall provide such modifications in the Contract <br /> Documents and/or negotiations with the low bidder as shall be <br /> necessary to bring the cost of the Project within the Project's <br /> budget. <br /> Article 2, paragraph 2 . 6 . 3 : Construction Phase duties, <br /> responsibility and limitation of authority of the Architect shall <br /> not be restricted, modified or extended without written agreement <br /> of the Owner and Architect and notice to Prime Contractors. <br /> Article 2 , paragraph 2.6 .4 : The Architect shall be the <br /> representative of the Owner during the construction phase of <br /> the contract period, and shall advise and consult with the <br /> Owner. Instructions to the Prime Contractors shall be forwarded <br /> through the Architect. The Architect shall have authority to act <br /> on behalf of the Owner only to the extent provided in this <br /> Agreement, unless otherwise modified by written agreement. <br /> Article 2 , paragraph 2. 6 . 5 : The Architect shall visit the site <br /> periodically at intervals appropriate to the stage of <br /> construction, or as otherwise agreed by the Owner and the <br /> Architect in writing and shall review the work in progress <br /> during these on-site visits to endeavor to determine for the <br /> Owner's benefit and protection if the work is proceeding in <br /> accordancewith the intent of the Contract Documents and the <br /> construction schedule. The Architect shall be held to the <br /> standard of care (with regard to review by on-site visits) which <br /> is generally accepted in the industry among architects of similar <br /> skill and standing in the community.
