2 <br />To preserve the status quo pending the consideration of a land use ordinance <br />amendment designed to address exigent circumstances or the results of a study, the <br />Town of Carrboro or the Town of Chapel Hill may propose the adoption of a <br />development moratorium pending consideration of the ordinance amendment. With <br />respect to the CJDA, any proposed moratorium shall not be effective until adopted by <br />the Town of Carrboro and approved by Orange County following a public hearing <br />conducted by the Town of Carrboro. <br />A public hearing by Orange County is not required prior to a BOCC decision on the moratorium. <br />However, the. Commissioners desire to hear the views of residents who might be affected by the <br />moratorium and a regularly scheduled BOCC meeting on March 27 precluded their attendance <br />at the Carrboro public hearing. Thus, time was set-aside at the conclusion of the JPA public <br />hearing on April 26, 2007 for the BOCC to receive public comment prior to considering action on <br />the moratorium request. Comment was received from two speakers, both opposing the <br />moratorium. <br />The BOCC referred this item to the Planning Board for comment and recommendations on May <br />2, 2007 and returning to the BOCC the following day May 3, 2007. A full Planning Board <br />agenda and lengthy discussion on a development proposal precluded the Planning Board from <br />discussing the moratorium on May 2. It was subsequently placed on the June 6, 2007 Planning <br />Board agenda. <br />Following a presentation by Planning Director, Craig Benedict, and Planning Board question and <br />comment, Board member,. Judith Wegner made atwo-part motion which was seconded by Brian <br />Crawford; see below incorporation of motion into the recommendation. <br />Vote: 8 in favor, 2 opposed. <br />FINANCIAL IMPACT: There is no cost to Orange County associated with this item. <br />RECOMMENDATION(S): The Administration concurs with the Planning Board <br />recommendation as noted below: <br />1. That any such moratorium not apply to projects for which proposed request for rezoning <br />or permits have been properly filed and are pending at this time; and <br />2. That for other proposals not yet submitted, that we would support and recommend that <br />they adopt asix-month moratorium effective at the time of adoption and be effective to <br />December. 26 2007. <br />
