shall pay all bills for its consumption of water, electricity, or other public utility service to the <br />Project site. <br />7.26 The Contractor shall indemnify and hold the CMAR, the Owner, the Designer, the <br />Designer's consultants, and their respective officers, agents, and employees harmless <br />against. all costs, damages, and expenses, including attorney's fees and costs of defense, <br />arising out of claims by any separate contractor or by any Subcontractor, sub- <br />subcontractor, or supplier engaged by or employed by the Contractor ar employed by any <br />of the Subcontractors claiming through hirn, including without (imitation damages, losses, <br />and expenses arising out of ar relating to any inconvenience, delay, interference, or other <br />action or non-action of the Contractor or the Contractor's Subcontractors on the Project. <br />The Contractor acknowledges that should the Contractor or any of the Contractor's <br />Subcontractors be damaged by any breach of contract by any other separate contractor on <br />the Project, the Contractor may invoke applicable dispute resolution procedures with said <br />other separate contractor. <br />7.27 Prior to completion of the Work and Final Payment of the Contract Price, excepting only <br />those portions of the Work deemed accepted in accordance with the Contract Documents, <br />the Contractor shall have charge and care of the Work, and shall take every precaution <br />against injury or damage to any party due to the action of the elements or from any other <br />cause, whether arising from the execution or from the non-execution of the Work. The <br />Contractor shall, as required by the CMAR, replace, rebuild, repair, restore, and make good <br />all injury or damage to any portion of the Work occasioned by any of the above causes <br />before Final Completion and shall bear the expenses thereof. <br />7.28 In the event that the Wark, or any portion thereof, is suspended at any time pursuant to an <br />order of the Owner, the Contractor shall obey all instructions of the CMAR regarding <br />storage of materials, drainage, protection of the Work, and erection of temporary structures <br />during the suspension period. <br />7.29 The CMAR shall be responsible for the coordination of the Work of the separate <br />contractors, bath as to space and time. The CMAR shall incorporate the Contractor's <br />Construction Schedule into the Master Schedule and coordinate the implementation of the <br />Contractor's Construction Schedule. The CMAR shall also coordinate close-out of the <br />Project, including but not limited to all testing, inspection, certifications, and approvals <br />required by public agencies. <br />The Contractor shall notify the CMAR promptly of any event or condition which could affect <br />the conduct or progress of the Work and shall cooperate fully with the CMAR and all other <br />separate contractors on the Project site. <br />7.30 The Owner has delegated to the CMAR all of its duties to coordinate and to expedite the <br />Work not expressly reserved to the Owner by other provisions of the Contract Documents. <br />7.31 Ail Work performed pursuant to the Gontract Documents shall conform in all respects to the <br />North Carolina State Building Gode and all other state, local, and national codes in effect at <br />the time of and applicable to this Work. <br />7.32 The CMAR shall coordinate and supervise the installation of all sleeves, inserts, chases or <br />other components of the Work needed for mechanical, p{umbing, electrical or other work by <br />the various contractors. The responsibility for exact location of such items shall be that of <br />the mechanical, plumbing, electrical or other prime contractor that requires the item for <br />passage ar support of its work. Generally, the mechanical, plumbing, electrical or other <br />contractor that requires such items far support or passage of its work shall set its sleeves, <br />inserts, chases or other devices.
