A minimum 50 foot wide Pedestrian Open Space Area (POSA) shall be <br />provided between lot 29 in phase 2 and lot 19 in phase 3, and lots 14 and <br />15 in phase 3. <br />9. An integrated, interconnected walking trail system shall connect this phase <br />with phase 2. <br />If more major subdivision development occurs along Pleasant Green Trail a right turn deceleration or full <br />right turn lane on Pleasant, Green Road shall be reviewed by Staff and NCDOT. <br />• Third Action: Planning Board to consider Preliminary Plan <br />Options: 1. Action within two regularly scheduled Planning Board meetings, or extension thereof; <br />2. If the Planning Board fails to act within the specified time period, application forwarded to BOCC <br />with Planning Board minutes and Planning Staff recommendations and conditions. <br />Preliminary Plan: Addresses the conditions of approval of the Concept Plan. Additional conditions have <br />been placed in the attached Recommendation of Approval. <br />Fourth Action: Board of County Commissioners to hear Planning Board recommendation. <br />RECOMMENDATION(S): Staff Recommendation <br />The Planning Staff recommends Approval of the Preliminary Plan for Pleasant <br />Green Woods Phase 3 with the attached Recommendation of Approval. <br />Eddie Kirk: The property is surrounded by subdivision and to the East is the Eno River State Park. The handout you <br />received is a letter from the North Carolina Department of Environmental and Natural Resources regarding land that <br />has been proposed to be given to the Eno State Park. The letter states they will accept that property. The concept <br />plan was approved on July 12, 2006 with 10 conditions and these conditions have been complied with. We have a <br />recommendation from the Recreation and Parks Advisory Council recommending the developer provide 10,000 <br />square feet of playground area with apparatus and swings as well as a picnic shelter with a minimum capacity of 100 <br />to be located in the open space area owned by the Homeowners Association. We did not include this in our <br />recommendations. We feel that the developer is going beyond the maximum required for recreation by providing the <br />17.34 acres to the Eno River State Park. He is also providing a walking trail thru the subdivision and this is going <br />beyond what's required in our ordinance for recreation purposes. We are recommending approval with the attached <br />recommendation in your packet. <br />Bernadette Pelissier: The recent memo from Rick Shaw dated June 15, 2007 recommended to include open space <br />B to convey that to the.state. Previously it was said that there might have more restrictions. I have two questions: Is it <br />true that deeded to the state means that there is more rigorous herbicide use? And if the intention to deed the open <br />space to the state will the herbicide be a problem for the streams and rivers? <br />Eddie Kirk: The State will have more restrictions on herbicide use. <br />Bernadette Pelissier: For future reference, is it true that you cannot spray herbicide? <br />Eddie Kirk: That is a question I cannot answer. <br />Renee Price: I worked with an organization that had requested that Duke and others not use herbicide. <br />Craufurd Goodwin: I gather the land being dedicated to the Eno State Park is the 49.12 acres? <br />Eddie Kirk: The Park is to the east of the subdivision.
