A 07 Approved d 9/5/ <br />-pp - 03 <br />portion of this open space area be deeded to the Eno River State Park system, which is amenable to the <br />applicant. All lots have direct access to open space. <br />• Existing Homeowners Association will own and maintain the open space not deeded to the <br />State as well as, buffers, signage. <br />Waiter-Sewer: <br />• Individual wells. <br />• Individual septic systems. <br />• Public water and sewer is not available. <br />Recreation: <br />• Chapel Hill District Park <br />The Orange County Environment and Resource Conservation Department and the Recreation and Parks <br />Advisory Council are recommending a portion of the open space be deeded to the State for the Eno River <br />State Park. This area of approximately 17.34 acres is delineated on the Preliminary Plan. The developer is <br />also proposing a walking trail within the open space area to be owned by the Homeowners Association. <br />Payment in lieu would require approximately 15,246 square feet. The transferring of 17.34 acres to the State <br />Park would satisfy the payment-in-lieu option. <br />• In addition to the above the Recreation and Parks Advisory Council is recommending the developer provide <br />10,000 square feet of playground area with apparatus and swings as well as a picnic shelter with a minimum <br />capacity of 100 to be located in the open space area owned by the Homeowners Association. <br />Agency Review: <br />• See attached documentation from Fire Marshall, Recreation and NCDOT. ERCID has commented on the <br />homestead site and the dedication of Open Space to the State. (see attached comments) . <br />Development Process, Schedule, and Action <br />Planning Board: <br />• First Action: Neighborhood Information Meeting: Held June 21, 2006 <br />Second Action: Concept Plan approved by the Planning Board July 12, 2006 with the following <br />conditions: <br />1. The intersection and road alignments on the Preliminary Plan shall meet <br />NCDOT standards. <br />2. Homeowners Association documents thatprovide for maintenance of the <br />Open Space shall be submitted with the preliminary plan. Provisions shall be <br />included in the Homeowners Association documents that would prohibit tree <br />cuffing in the Open Space except for maintenance purposes. <br />3. Show proposed dedication of an additional 5 feet of right-of-way, or 35 feet <br />from C/L of existing R/W, whichever is greater, along Pleasant Green Road <br />on the Preliminary Plan. <br />4. Show five-foot utility easements along both sides of all rights-of-way. <br />5. The Eno River Association has recommended that a portion of the open <br />space be dedicated (deeded) * to the Eno River State Park system. The <br />dedication is part of the open space area on the east side of the property <br />and the amount will be determined in an agreement between the owners <br />and the Eno River Association. This will meet the requirement for recreation <br />and reduce or eliminate the amount of the recreation payment-in-lieu. <br />6. Show location of subdivision sign on Preliminary Plan. <br />7. Any lighting shall meet Orange County Lighting Standards. <br />
