3 <br />Open Space/Buffers: <br />0 36.75 acres (50%) of open space proposed. All of the open space is wooded except for the <br />area along the power transmission lines through the eastern side of the property. The Eno <br />River Association is requesting a portion of this open space area be deeded to the Eno River <br />State Park system, which is amenable to the applicant. All lots have direct access to open <br />space. <br />0 Existing Homeowners Association will own and maintain the open space not deeded to the <br />State as well as, buffers, signage. <br />Water-Sewer: <br />0 Individual wells. <br />Individual septic systems. <br />Public water and sewer is not available. <br />Recreation: <br />Chapel Hill District Park <br />The Orange County Environment and Resource Conservation Department and the <br />Recreation and Parks Advisory Council are recommending a portion of the open space <br />offered by the applicant be deeded to the State for the Eno River State Park. This area of <br />approximately 17.34 acres is delineated on the Preliminary Plan. The developer is also <br />proposing a walking trail within the remaining Homeowners Association open space area to <br />be owned by the Homeowners Association. Payment in lieu would require approximately 1. <br />acre. The transferring of 17.34 acres to the State Park would satisfy the, payment-in-lieu <br />option. <br />In addition to the above t ' he Recreation and Parks Advisory Council is recommending the <br />developer provide 10,000 square feet of playground area with apparatus and swings as well <br />as a picnic shelter with a minimum capacity of 100 to be located in the open space area <br />owned by the Homeowners Association. Planning Staff did not recommend this since with <br />the walking trail and dedication of 17.34 acres to the State Park the developer is going well <br />beyond the 1 acre required. <br />Agency Review: <br />• See attached documentation from Fire Marshall, Recreation and NCDOT. ERCD has <br />commented on the homestead site and the dedication of Open Space to the State. ( see <br />attached comments) <br />Development Process, Schedule, and Action <br />Planning Board: <br />• First Action: Neighborhood Information Meeting: Held June 21, 2006 <br />• Second Action: Concept Plan approved by the Planning Board July 12, 2006 with the <br />following conditions: <br />1. The intersection and road alignments on the Preliminary Plan shall <br />meet NCDOT standards. <br />2. Homeowners Association documents that provide for maintenance of <br />the Open Space shall be submitted with the preliminary plan. <br />Provisions shall be included in the Homeowners Association <br />documents that would prohibit tree cutting in the Open Space except <br />for maintenance purposes. <br />3. Show proposed dedication of an additional 5 feet of right-of-way, or <br />35 feet from C/L of existing R/W, whichever is greater, along <br />
