However, 1 do not feel the HOA alone can be as effective an <br />advocate for these issues as it might otherwise be given that the HOA (along with its Board of . <br />Directors) is still under.Declarant control. It is a conflict of interest for the HOA to be the sole <br />organ by which to work through these issues when some of the issues are, in fact, the <br />responsibility of the Declarant who has controlling interest within the HOA. <br />I am aware that there are multiple developers operating on various parcels of the land covered by <br />the ``Special Use Permit." The developers, it seems to me, have been effective at confusing the <br />issues by essentially pointing tl~e finger of responsibility at each other. Many of these issues have <br />been allowed to persist, with no progress, as a result. <br />But as a homeowner, a~taxpayer, and a voter it is very difficult for me to understand how new <br />pleases of the development can be allowed to proceed when there are so many elements from prior <br />phases yet to be completed, regardless of which developer is responsible.. The fact that one <br />developer has chosen to mitigate HIS risk by selling off phases of work to another developer does <br />not justify the county's acquiescence in'the face of longstanding unresolved issues. <br />The Special Use Permit is an essential mechanism by which the county and the homeowners are <br />supposed to be protected. The phasing condition within the Special Use Permit gives the county <br />considerable power to compel any and all developers to complete required work before future <br />phases are allowed to proceed. To the extent the various developers must actually work together <br />to ensure completion of certain conditions before either is allowed to continue developing then so <br />much the better. <br />Ultimately, my interest is to ensure that the county retains all the tools necessary to compel <br />developers to live up to their agreements. The homeowners in Churton Grove and Braddock Park <br />want a safe and aesthetically pleasing neighborhood filled with each of the code-compliant <br />amenities that developers committed to building in their agreements with the county. Many <br />residents have been waiting years for the completion of certain amenities.
