16 <br />a. Crosswalks are placed in accordance with NCDOT standards because these <br />streets are to be NCDOT maintained. NCDOT does not mandate crosswalks. <br />5. Lighting to Be Provided at Active Recreation Areas <br />There has been no discussion regarding the lighting of the all-purpose field. This <br />is an issue to be addressed by the HOA. <br />6. Lighting Along Sidewalks <br />Streetlights are placed per Duke Energy specifications. In order to balance the <br />lighting plan for the streets there will be times where light posts are placed <br />opposite the sidewalks. It may seem counterintuitive to not completely light the <br />sidewalks; however, the lights are streetlights, not sidewalk lights. If the HOA <br />wants more lights then Duke Energy would probably install them without delay. <br />With respect to the tot lot.and all-purpose field there is no proposal from the <br />developer to provide lighting. The lights needed would be expensive and the <br />HOA would have to pay to have them maintained and pay the monthly electric <br />bills. . <br />7. Playground Equipment <br />Once the picnic facility is installed trees may be added for the site. It will take <br />time for trees to establish a shady area for the'tot lot. <br />8. Soccer Field <br />The recreation area to be constructed in Phase IV is an all-purpose field, not a <br />soccer field per se. The comments regarding construction will be taken into <br />consideration and are helpful. With regard to irrigation, there has been no <br />discussion of irrigation of the fields. The SUP does not have an irrigation <br />requirement. <br />General Developer Concerns (please refer to Mr. Buck's correspondence) <br />1. Substandard Quality and/or Installation of Pool Equipment <br />This is not an SUP or regulatory issue. This is a matter between the HOA, <br />Churton Grove, LLC, the installer of the equipment, and Newland Communities, <br />the developer of Phases 3 and 4. <br />2. Substandard Quality of the Irrigation Equipment <br />See number 1 above. <br />3. Inadequate Landscaping at Churton Grove Main Entrance <br />The landscaping met SUP requirements when installed. Ongoing landscape <br />maintenance is an issue for Churton Grove, LLC, and the HOA. <br />4. Failure to Provide Two Tennis Courts <br />The SUP did not require the installation of a tennis court. The Developer built <br />one tennis court and a clubhouse in place of two tennis courts. <br />
