12 <br />18. Playground includes lumber with carcinogenic Chromated Copper <br />Arsenate (CCA). <br />Staff Comment: This is an issue for the developer, the HOA and the contractor <br />who installed the equipment. The Planning Department does not condone the <br />use of any product that is not in compliance with all federal, state and local <br />regulations. That said, the Planning Department does not verify suitability for play <br />apparatus, other than for the physical placement of equipment on the lot. <br />19. Metal drainage grate in play area is a safety hazard. <br />Staff Comment: The grate creates a potential hazard and it is incumbent that. <br />there be adult supervision for younger children using the area. This issue is <br />properly addressed to the HOA, and Staff encourages the HOA to remedy the <br />situation. <br />20. No picnic area in Churton Grove <br />Staff Comment: Churton Grove, LLC, is aware of this requirement and <br />understands it is to be accomplished prior to completion of Braddock Park town <br />homes. Target date for completion is April 2008. <br />21. No recreation facilities in Braddock Park. <br />Staff Comment: Recreation facilities (pool, picnic table, grill, restrooms, etc) are <br />to be provided when Section 2 of the multi-family town homes are built, estimated <br />to be completed in the spring of 2008. <br />22. Developer provided asphalt walking paths not to code: <br />Mr. Buck is requesting information demonstrating that the various walking paths <br />have been built in compliance with Section 46-79 (b) (4) of the Orange County <br />Zoning Ordinance. <br />Staff Comment: As stated earlier there are numerous trails that have not been <br />constructed but will be prior to completion of the Development. Built trails are the <br />responsibility of both the HOA and the individual homeowners who own the land <br />under the trails. <br />23. Developer provided basketball court not to code. <br />Mr. Buck is requesting information demonstrating that the installed basketball <br />facilities are in compliance with Section 46-79 (b) (4) of the Orange County <br />Zoning Ordinance. <br />Staff Comment: The SUP requires the installation of a "full-length basketball <br />court." According to the developer the basketball court was intended to provide <br />recreation for the residents and their guests and was not intended to <br />accommodate sanctioned athletic events. <br />24.Designated Pedestrian Open Space Parcel (POSA)'not in compliance. <br />Staff Comment: This is a Flexible Development requirement. It is not <br />applicable to this project. <br />
