Designated passive recreation parcel not in compliance (SUP): <br />Mr. Buck is requesting information demonstrating that the acreage contained <br />within the parcel of property with PIN 9875-81-5631, and designated as Passive <br />Recreation Area, is compliant with SUP condition number 27-D that reads as <br />follows: <br />`Along either side of Nancy Hill Creek, designate 100 ft as open <br />pace/passive areas with walking and hiking paths. Provide public <br />walkways (to be part of the designated `open space area) to these areas <br />from both Graham Drive and Cameron Circle. Install bridges across the <br />creek at either end, and midway, in conjunction with the public walkways. <br />A pedestrian and non-motorized vehicle easement shall be dedicated <br />coterminous with the open space area.' <br />The construction of these walking paths was delayed until Phase 4 construction. <br />Staff determined that for safety reasons connection of both trails at the location <br />where the bridge was to be constructed would encourage resident usage of the <br />trails and paths at locations that would be used for staging of construction <br />equipment. When major construction in Phase 4 is completed, the trails will be <br />finished; we estimate that this will be in April of 2008. <br />With the passage of the Neuse River Buffer regulations, the County's adoption of <br />Stream Buffer regulations, and the remapping of the FEMA floodplain, which <br />affects application of the above regulations, staff has determined that these trails <br />need to be shifted up the hill (i.e. parallel to Stroud's Creek). This was necessary <br />to avoid encroachment into the stream buffers or FEMA flood plain. The Neuse <br />River Basin rules limit disturbance along streams and a variance from the state <br />would be needed to construct pedestrian bridges. The current plat is to connect <br />
