ORANGE COUNTY <br />BOARD OF COMMISSIONERS <br />ACTION AGENDA ITEM ABSTRACT <br />Meeting Date: October 9, 2007 <br />Action Agenda <br />Item No. ~. <br />SUBJECT: Encroachment Agreement for Eubanks Road Sidewalk re: Animal Services <br />Facility Project <br />DEPARTMENT: Purchasing and Central PUBLIC HEARING: (Y/N) No <br />Services <br />ATTACHMENT(S): INFORMATION CONTACT: <br />Pam Jones (919) 245-2652 <br />Encroachment Agreement <br />PURPOSE: To consider approving a Three Party Right of Way Encroachment Agreement <br />among the North Carolina Department of Transportation (NCDOT), Orange County and the <br />Town of Chapel Hill for sidewalks and handicap ramps along the Eubanks Road frontage of the <br />Animal Services Center Facility. <br />BACKGROUND: The Special Use Permit issued by the Town of Chapel Hill for the Animal <br />Services Facility project includes approximately 300 linear feet of sidewalk along the property <br />frontage on Eubanks Road. This Encroachment Agreement authorizes the construction of the <br />sidewalk on the NCDOT right-of--way by the County and the subsequent transfer of ownership <br />and on-going maintenance of the completed project to the Town of Chapel Hill. <br />FINANCIAL IMPACT: Based solely on estimated linear construction costs for sidewalk, the <br />estimated cost of the sidewalk is $6,000. This amount will be included in the guaranteed <br />maximum price for construction of the facility, which will be presented for Board consideration at <br />the conclusion of the design process, tentatively scheduled for February 11, 2008. <br />RECOMMENDATION(S): The Manager recommends that the Board approve the Three Party <br />Right of Way Encroachment Agreement among the North Carolina Department of <br />Transportation, Orange County and the Town of Chapel Hill for sidewalks and associated <br />handicapped ramps along the Eubanks Road frontage of the Animal Services Facility; and <br />authorize the Chair to sign on behalf of the Board. <br />
