133 <br /> The flow of water in the intermittent stream may be heavily supplemented <br /> by stormwater runoff. <br /> It often lacks the biological and hydrological characteristics commonly <br /> associated with the conveyance of water." <br /> SECTION 4.31.(b) The Department of Environment and Natural Resources and <br /> the Environmental Management Commission shall amend their rules so that the rules are <br /> consistent with the provisions of G.S. 143-214.7C, as enacted by subsection (a) of this section. <br /> PIGEON HUNTING <br /> SECTION 4.32(a) G.S. 14-360(c)reads as rewritten: <br /> "(c) As used in this section, the words "torture", "torment", and "cruelly" include or refer <br /> to any act, omission, or neglect causing or permitting unjustifiable pain, suffering, or death. As <br /> used in this section, the word "intentionally" refers to an act committed knowingly and without <br /> justifiable excuse, while the word "maliciously" means an act committed intentionally and with <br /> malice or bad motive. As used in this section, the term "animal" includes every living <br /> vertebrate in the classes Amphibia, Reptilia, Aves, and Mammalia except human beings. <br /> However, this section shall not apply to the following activities: <br /> (1) The lawful taking of animals under the jurisdiction and regulation of the <br /> Wildlife Resources Commission, except that this section shall apply to those <br /> birds other than pigeons exempted by the Wildlife Resources Commission <br /> from its definition of"wild birds"pursuant to G.S. 113-129(15a). <br /> (2) Lawful activities conducted for purposes of biomedical research or training <br /> or for purposes of production of livestock,poultry, or aquatic species. <br /> (2a) Lawful activities conducted for the primary purpose of providing food for <br /> human or animal consumption. <br /> (3) Activities conducted for lawful veterinary purposes. <br /> (4) The lawful destruction of any animal for the purposes of protecting the <br /> public, other animals,property, or the public health. <br /> (5) The physical alteration of livestock or poultry for the purpose of conforming <br /> with breed or show standards." <br /> SECTION 4.32.(b) G.S. 19A-1.1 reads as rewritten: <br /> "§ 19A-1.1. Exemptions. <br /> This Article shall not apply to the following: <br /> (1) The lawful taking of animals under the jurisdiction and regulation of the <br /> Wildlife Resources Commission, except that this Article applies to those <br /> birds other than pigeons exempted by the Wildlife Resources Commission <br /> from its definition of"wild birds"pursuant to G.S. 113-129(15a). <br /> WILDLIFE RESOURCES COMMISSION STUDIES <br /> SECTION 4.33.(a) The Wildlife Resources Commission shall review the methods <br /> and criteria by which it adds, removes, or changes the status of animals on the State protected <br /> animal list as defined in G.S. 113-331 and compare these to federal regulations and the <br /> methods and criteria of other states in the region. The Commission shall also review the <br /> policies by which the State addresses introduced species and make recommendations for <br /> improving these policies, including impacts associated with hybridization that occurs among <br /> federally listed, State-listed, and nonlisted animals. <br /> SECTION 4.33.(b) The Wildlife Resources Commission shall report its findings <br /> and recommendations to the Environmental Review Commission by March 1, 2016. <br /> SECTION 4.34.(a) The Wildlife Resources Commission shall establish a coyote <br /> management plan to address the impacts of coyotes in this State and the threats that coyotes <br /> pose to citizens, industries, and populations of native wildlife species within the State. <br /> SECTION 4.34.(b) The Wildlife Resources Commission shall report its findings <br /> and recommendations, including any proposed legislation to address overpopulation of coyotes, <br /> to the Environmental Review Commission by March 1, 2016. <br /> SECTION 4.35.(a) The Wildlife Resources Commission shall establish a pilot <br /> coyote management assistance program in Mitchell County.
