The Commission shall establish minimttm tetins <br /> t 14y opetuted and maintained. <br /> 01) Clarification With Respect to Certain Dispersal Media. – In considering the <br /> application by a manufacturer of a wastewater system utilizing expanded polystyrene synthetic <br /> aggregate particles as a septic effluent dispersal medium for approval of the system under this <br /> section, neither the Commission nor the Department may condition, delay, or deny the approval <br /> based on the particle or bulk density of the expanded polystyrene material. With respect to <br /> approvals already issued by the Department or Commission that include conditions or <br /> requirements related to the particle or bulk density of expanded polystyrene material, the <br /> Commission or Department, as applicable, shall promptly reissue all such approvals with the <br /> conditions and requirements relating to the density of expanded polystyrene material <br /> permanently deleted while leaving all other terms and conditions of the approval intact. <br /> (k) Fees. – The Department shall collect the following fees under this section: <br /> (1) Review of an alternative protocol <br /> under subsection (d) of this section $1,000.00 <br /> (24 Re o of An exper—ental system $3,000.00 <br /> (3) Review of a a°mefistF `ieff visional system $3,000.00 <br /> (4) Review of an innovative system $3,000.00 <br /> (5) Review of an accepted system $3,000.00 <br /> (6) Review of a residential wastewater treatment <br /> system pursuant to G.S. 130A-342 $1,500.00 <br /> (7) Review of a component or device required of a system $ 100.00 <br /> (8) Modification to approved accepted,provisional, or $1,000.00 <br /> innovative system <br /> (1) On-Site Wastewater System Account. – The On-Site Wastewater System Account is <br /> established as a nonreverting account within the Department. Fees collected pursuant to this <br /> section shall be placed in the On-Site Wastewater System Account and shall be applied only to <br /> the costs of implementing this section." <br /> SECTION 415.(b) The Commission for Public Health shall review and amend its <br /> rules to implement Section 4.15(a) of this act. <br /> SECTION 415.(c) Beginning January 1, 2016, and every quarter thereafter until <br /> all rules required pursuant to Sections 4.14 and 4.15 of this act are adopted or amended, the <br /> Commission for Public Health shall submit written reports as to its progress on adopting or <br /> amending rules as required by Sections 4.14 and 4.15 of this act to the Environmental Review <br /> Commission and the Joint Legislative Oversight Committee on Health and Human Services. <br /> The Commission shall supplement the written reports required by this subsection with <br /> additional written and oral reports as may be requested by the Environmental Review <br /> Commission and the Joint Legislative Oversight Committee on Health and Human Services. <br /> The Commission shall submit the written reports required by this subsection whether or not the <br /> General Assembly is in session at the time the report is due. <br /> SECTION 415.(d) The Commission for Public Health, in consultation with the <br /> Department of Health and Human Services, local health departments, and stakeholders <br /> representing the wastewater system industry, shall study the costs and benefits of requiring <br /> treatment standards greater than those listed by nationally recognized standards, including the <br /> recorded advantage of such higher treatment standards for the protection of the public health <br /> and the environment. The Commission shall report its findings and recommendations, <br /> including any legislative proposals, to the Environmental Review Commission and the Joint <br /> Legislative Oversight Committee on Health and Human Services on or before March 1, 2016. <br /> CONTESTED CASES FOR AIR PERMITS <br /> SECTION 4.17.(a) G.S. 143-215.108 reads as rewritten: <br /> "§ 143-215.108. Control of sources of air pollution; permits required. <br /> (e) A permit applieant, pe i'ttee^r ` xl4mpplicant or permittee who is <br /> dissatisfied with a decision of the Commission on a permit application may commence a <br /> contested case by filing a petition under G.S. 150B-23 within 30 days after the Commission <br /> House Bill 765-Ratified Session Law 2015-286 Page 53 <br />
