111 <br /> AMEND THE DEFINITION FOR "PROSPECTIVE DEVELOPER" UNDER THE <br /> LAW GOVERNING BROWNFIELDS REDEVELOPMENT <br /> SECTION 4.10.(a) G.S. 130A-310.31(b)(10) reads as rewritten: <br /> "§ 130A-310.31. Definitions. <br /> (a) Unless a different meaning is required by the context or unless a different meaning <br /> is set out in subsection (b) of this section, the definitions in G.S. 130A-2 and G.S. 130A-310 <br /> apply throughout this Part. <br /> (b) Unless a different meaning is required by the context: <br /> (10) "Prospective developer" means any person with a bona fide, demonstrable <br /> desire to eitn°r btty sell a et:ty f°r toe ose 0 <br /> deve epin g et: t:edevelepif g t44develop or redevelop a brownfields property <br /> and who did not cause or contribute to the contamination at the brownfields <br /> property." <br /> SECTION 4.10.(b) This section becomes effective December 1, 2015, and applies <br /> to Notices of Intent to Redevelop a Brownfields Property filed on or after that date. <br /> ELIMINATE OUTDATED FEES RELATED TO SOLID WASTE MATTERS <br /> SECTION 4.1L(a) G.S. 105-102.6 is repealed. <br /> SECTION 4.1L(b) G.S. 130A-309.17(d) and(i) are repealed. <br /> DELETE OR REPEAL VARIOUS ENVIRONMENTAL AND NATURAL RESOURCES <br /> REPORTING REQUIREMENTS <br /> SECTION 4.12.(a) G.S. 113-175.6 is repealed. <br /> SECTION 4.12.(b) G.S. 113-182.1(e) reads as rewritten: <br /> "§ 113-182.1. Fishery Management Plans. <br /> (e) The Secretary of Environment and Natural Resources shall monitor progress in the <br /> development and adoption of Fishery Management Plans in relation to the Schedule for <br /> development and adoption of the plans established by the Marine Fisheries Commission. The Joint Legislative Commission on <br /> Governmental Operations may submit comments and recommendations on the proposed Plan <br /> to the Secretary within 30 days of the date the proposed Plan is submitted by the Secretary." <br /> SECTION 4.12.(c) G.S. 14313-279.15 is repealed. <br /> SECTION 4.12.(d) G.S. 143B-289.44(4)is repealed. <br /> SECTION 4.12.(e) G.S. 159I-29 is repealed. <br /> SECTION 4.12.(f) Section 2.3 of S.L. 2007-485 is repealed. <br /> ON-SITE WASTEWATER AMENDMENTS AND CLARIFICATIONS <br /> SECTION 4.14.(a) G.S. 130A-334 reads as rewritten: <br /> "§ 130A-334. Definitions. <br /> The following definitions shall apply throughout this Article: <br /> (1) "Accepted wastewater system" has the same meaning as in G.S. 130A-343. <br /> 1 a "Approved agency for special inspection" means an individual, corporation, <br /> company, association, or partnership that is objective, competent, and <br /> independent from the contractor who is responsible for the work that is <br /> inspected. The agency shall disclose possible conflicts of interest in a <br /> manner such that objectivity can be confirmed. <br /> "Approved special inspector" means a person who demonstrates competence <br /> to the satisfaction of the professional engineer who designed the wastewater <br /> House Bill 765-Ratified Session Law 2015-286 Page 37 <br />
