Age restrictions. <br /> (a) It is unlawful for any parent or legal guardian of a person less than eight years of <br /> age to knowingly permit that person to operate an all-terrain vehicle. <br /> (c) It is unlawful for any parent or legal guardian of a person less than 16 years of age <br /> to knowingly permit that person to operate an all-terrain vehicle V�,44 an °figin° ,.,,rae4l,y gr-e t°r <br /> 4iaa 90—e4ie een et°. seffw-P in violation of the Age Restriction Warning Label <br /> affixed by the manufacturer as required by the aplicable American National Standards <br /> Institute/Specialty Vehicle Institute of America(ANSI/SVIA) design standard. <br /> (d) It is unlawful for any parent or legal guardian of a person less than 16 years of age <br /> to knowingly permit that person to operate an all-terrain vehicle unless the person is under the <br /> continuous visual supervision of a person 18 years of age or older while operating the <br /> all-terrain vehicle. <br /> (e) Sttbseetio,,s (b) and Subsection (c) of this section does not apply to any parent or <br /> legal guardian of a person born on or before August 15, 1997, who permits that person to <br /> operate an all-terrain vehicle and who establishes proof that the parent or legal guardian owned <br /> the all-terrain vehicle prior to August 15, 2005." <br /> SECTION 3.13.(b) G.S. 20-171.17 reads as rewritten: <br /> "§ 20-171.17. ENVIRONMENTAL AND NATURAL RESOURCES REGULATION <br /> ENVIRONMENTAL SELF-AUDIT PRIVILEGE AND LIMITED IMMUNITY <br /> SECTION 41.(a) Chapter 8 of the General Statutes is amended by adding a new <br /> Part to read: <br /> "Part 71). Environmental Audit Privilege and Limited Immunity_ <br /> 8-58.50. Purpose. <br /> (a) In order to encourage owners and operators of facilities and persons conducting <br /> activities regulated under those portions of the General Statutes set forth in G.S. 8-58.52, or <br /> conducting activities regulated under other environmental laws, to conduct voluntary internal <br /> environmental audits of their compliance programs and management systems and to assess and <br /> improve compliance with statutes, an environmental audit privilege is recognized to protect the <br /> confidentiality of communications relating to voluntary internal environmental audits. <br /> (b,) Nothing in this Part shall be construed to protect owners and operators of facilities <br /> and regulated persons from a criminal investigation or prosecution carried out by any <br /> appropriate governmental entity_ <br /> (c) Any-privilege granted by this Part shall aply only to those communications, oral or <br /> written, pertaining to and made in connection with the environmental audit and shall not aply <br /> to the facts relating to the violation itself. <br /> "§ 8-58.51.
