76 <br /> The third party must submit the recommendation or consultation at least 60 <br /> days prior to the expiration of the term or within 10 business days from the <br /> occurrence of a vacancy. <br /> Failure by the third party to submit the recommendation or consultation to <br /> the legislator within the time periods required under this subsection shall be <br /> deemed a waiver by the third party of the opportunity_ <br /> (f) The following applies in any case where the Speaker of the House of <br /> Representatives or the President Pro Tempore of the Senate is directed by law to make a <br /> recommendation for an appointment by the General Assembly, and the legislator is also <br /> directed to make the recommendation from nominees provided by a third party <br /> The third party must submit the nominees at least 60 days prior to the <br /> expiration of the term or within 10 business days from the occurrence of a <br /> vacancy. <br /> Failure by the third party to submit the nomination to the legislator within <br /> the time periods required under this subsection shall be deemed a waiver by <br /> the third party of the opportunity" <br /> SECTION 1.3.(b) Article 16 of Chapter 120 of the General Statutes is amended by <br /> adding a new section to read: <br /> 120-124. Appointments made by legislators. <br /> (aa,) In any case where a legislator is called upon by law to appoint a member to a board <br /> or commission upon the recommendation of or in consultation with a third party, the <br /> recommendation or consultation is discretionary and is not binding upon the legislator. The <br /> third party must submit the recommendation or consultation at least 60 days prior to the <br /> expiration of the term or within 10 business days from the occurrence of a vacancy_ <br /> In any case where a legislator is called upon by law to appoint a member to a board <br /> or commission from nominees provided by a third party, the third party must submit the <br /> nominees at least 60 days prior to the expiration of the term or within 10 business days from the <br /> occurrence of a vacancy. This subsection does not apply to nominations made under <br /> G.S. 120-99(a) or G.S. 120-100(b). <br /> (c) Failure to submit the recommendation, consultation, or nomination within the time <br /> periods required under this section shall be deemed a waiver by the third party of the <br /> opportunity_" <br /> SECTION 1.3.(c) This section is effective when this act becomes law and applies <br /> to recommendations, consultations, and nominations made on or after that date. <br /> OCCUPATIONAL LICENSING BOARD INVESTIGATORS AND INSPECTORS <br /> SECTION 1.5. Chapter 93B of the General Statutes is amended by adding a new <br /> section to read: <br /> 93B-8.2. Prohibit licensees from serving as investigators. <br /> No occupational licensing board shall contract with or employ a person licensed by the <br /> board to serve as an investigator or inspector if the licensee is actively practicing in the <br /> profession or occupation and is in competition with other members of the profession or <br /> occupation over which the board has jurisdiction. Nothing in this section shall prevent a board <br /> from (i) employing licensees who are not otherwise employed in the same profession or <br /> occupation as investigators or inspectors or for other purposes or (ii) contracting with licensees <br /> of the board to serve as expert witnesses or consultants in cases where special knowledge and <br /> experience is required, provided that the board limits the duties and authority of the expert <br /> witness or consultant to serving as an information resource to the board and board personnel." <br /> NO FISCAL NOTE REQUIRED FOR LESS STRINGENT RULES <br /> SECTION 1.6.(a) G.S. 150B-21.3A(d)reads as rewritten: <br /> "(d) Timetable. — The Commission shall establish a schedule for the review and <br /> readoption of existing rules in accordance with this section on a decennial basis as follows: <br /> (2) With regard to the readoption of rules as required by sub-subdivision (c)(2)g. <br /> of this section, once the final determination report becomes effective, the <br /> Commission shall establish a date by which the agency must readopt the <br /> rules. The Commission shall consult with the agency and shall consider the <br /> agency's rule-making priorities in establishing the readoption date.
