60 <br /> 4. Objective LU-3.5: Recognize the right to farm and discourage the location of <br /> new non-farm development, particularly more intensive residential development, <br /> within farming areas to minimum the incidence of complaints and nuisance suits <br /> against farm operations. <br /> 5. Objective LU-3.9: Create new zoning district(s) which allow for a mixing of <br /> commercial and residential uses, a mixing of housing types, and creates a more <br /> pedestrian friendly development pattern. New districts should be applied in <br /> areas where public services exist or are planned for in the future, in areas that <br /> promote higher intensity and high density uses on the Future Land Use map. <br /> The amendments are reasonable and in the public interest because: <br /> a. The amendment allows the development of a project achieving a reasonable balance <br /> of protecting existing natural area and land uses (i.e. farming operations) while <br /> allowing for an appropriate level of residential development at a density of 1 unit for <br /> every 3 acres. <br /> The current zoning designation allows development at a potential density of 1 unit for <br /> every 40,000 sq. ft. of land area with no guarantee existing farmland or mature forest <br /> would be preserved. <br /> b. The amendment allows for the development of a pedestrian friendly community with <br /> different housing options for residents. <br /> The project requires vehicles to be parked in designated areas prohibiting access to <br /> individual residential structures, which shall be access via a proposed pedestrian trail <br /> system. <br /> c. The project will not result in traffic impacts deemed to be detrimental to existing <br /> roadways due to the proposed density. <br /> d. The proposed amendments promote public health, safety, and general welfare by <br /> furthering the goals and objectives of the 2030 Comprehensive Plan. <br /> The Planning Board hereby recommends that the Orange County Board of County <br /> Commissioners consider adoption of the proposed Zoning Atlas amendments. <br /> Pete Hallenbeck, Chair Date <br />
