3 7 <br /> 1 Commissioner Price asked if the zoning is granted will the property borders protect the <br /> 2 neighbors to the east as well as residential areas to the south of the railroad. <br /> 3 Patrick Mallet said the Railroad Right of Way (ROW) is 250 feet and a good portion of <br /> 4 this property is part of the Duke Forest property. He said there is a 100-foot buffer along the <br /> 5 County lines. <br /> 6 Chad Abbott said the buffer is not associated with the resource protection area. He said <br /> 7 that the whole Economic Development District is required to have a 100-foot buffer around it. <br /> 8 Commissioner Rich asked if it is common to have an EDD-1 and EDD-2 within the same <br /> 9 property and if there is any precedent <br /> 10 Michael Harvey said it is not uncommon and there other areas of split zoning in the <br /> 11 County. <br /> 12 Commissioner Rich asked if property owners are encouraged not to split the zoning. <br /> 13 Michael Harvey said the County works with property owners to try and find solutions. <br /> 14 Commissioner Rich asked if the Planning Board had any comments. She said she <br /> 15 would rather not be reactionary. <br /> 16 Michael Harvey said the County has been working for almost a year to reach out to <br /> 17 owners of split-zoned properties to work out the best solutions. He said a joint amendment to <br /> 18 the Zoning Atlas Map is moving forward. He said there are also properties that are split zoned <br /> 19 commercial and residential. <br /> 20 <br /> 21 Public Comment: <br /> 22 NONE <br /> 23 <br /> 24 A motion was made by Commissioner Price, seconded by Commissioner Pelissier to <br /> 25 approve: <br /> 26 <br /> 27 1. Referring the matter to the Planning Board with a request that a recommendation be returned <br /> 28 to the Board of County Commissioners in time for the November 5, 2015 BOCC regular <br /> 29 meeting; and <br /> 30 2. Adjourning the public hearing until November 5, 2015 in order to receive and accept the <br /> 31 Planning Board's recommendation and any submitted written comments. <br /> 32 <br /> 33 VOTE: UNANIMOUS <br />
