15 <br /> 1 STAFF COMMENT. the ORC reviewed this item at its July 1, 2015 meeting where the <br /> 2 following comments/questions were made: <br /> 3 Could a resident, on his own property, sponsor a club in his name and finance <br /> 4 play on the field under this proposal? <br /> 5 STAFF COMMENT. As the Ordinance is currently written the property owner would <br /> 6 have to get a special use permit. The reason being the field is intended to serve the <br /> 7 needs of the general public, even if they are members of a club or other similar <br /> 8 organization, with respect to providing the use of a recreational facility. <br /> 9 • So I can't develop a putting green on my property? <br /> 10 STAFF COMMENT. You can have a recreational facility on your property and use it for <br /> 11 recreational purposes. This would include a putting green. From my standpoint the <br /> 12 problem occurs when you open the recreational amenity up for public use/access. <br /> 13 When this occurs you change the nature of the use of property and, I believe, it becomes <br /> 14 more than a simple accessory use to your residence. It becomes a recreational facility <br /> 15 used to satisfy the needs of the general public. <br /> 16 Could a farmer donate land to a non-profit organization to allow for the <br /> 17 development of a recreational facility? <br /> 18 STAFF COMMENT. Yes but they would have to obtain a Class B Special Use Permit for <br /> 19 the use. This is the current requirement and we are not recommending a change to the <br /> 20 existing process. <br /> 21 Is the intent with this regulation to control the development of gun ranges <br /> 22 specifically? <br /> 23 STAFF COMMENT. We are adopting regulations and development standards <br /> 24 associated with them but the proposed amendment seeks to do more than just establish <br /> 25 regulations on public or private gun ranges. <br /> 26 Could a local homeowners association develop a recreational land use on HOA <br /> 27 owned property for local residents to take advantage of? <br /> 28 STAFF COMMENT. Yes. This text amendment will not preclude that. The <br /> 29 homeowners association would, however, have to amend the previously approved <br /> 30 subdivision final plat to incorporate the new recreation amenity in accordance with the <br /> 31 UDO. <br /> 32 • Will this proposed amendment impact County parks? <br /> 33 STAFF COMMENT. No. <br /> 34 Staff and the County Attorney's office have determined existing definitions and <br /> 35 classification methodology for recreation land uses (i.e. relying on the profit/non-profit status of <br /> 36 said operation) is inappropriate and inconsistent with acceptable legal practice. The current <br /> 37 methodology has concerned staff for some time and has even complicated recent enforcement <br />
