STRATEGIC GROWTFI AND RURAL CONSERVATION PROGRAM <br />Draft (10.1.2007) <br />STATE OF NORTH CAROLINA <br />COUNTY OF ORANGE <br />WARI'2ANTY <br />DEED OF STRATEGIC GROWTH AND RURAL CONSERVATION PROGRAM (SGRC) <br />EASEMENT <br />This Deed of Agricultural Conservation Easement ("Conservation Easement") is granted on this <br />day of , 20~ by and , <br />[husband and wife,] having an address of Road, , NC 27_ (referred to as <br />"Grantors"), to ORANGE COUNTY, NORTH CAROLINA, having an address of Post Office Box 8181, <br />Hillsborough, NC 27278 (referred to as "Grantee"). <br />PART L GRANTOR CONDITIONS <br />WHEREAS: <br />(1) Grantors are the sole owners in fee simple, of certain farm Property, more particularly <br />described in Exhibit A, attached hereto and incorporated herein (the "Property"), which consists of <br />approximately acres of land, located in Township, Orange County, North Carolina <br />and identified as that portion of Tract that is not depicted as " " on the plat of property titled <br />"Property of ," prepared by ,Inc., which plat is recorded at <br />Plat Book _, Page _, Orange County Registry (PIN -_-_). The Property includes buildings <br />and other improvements, which are shown on Exhibit B, attached hereto and incorporated herein. <br />(2) Development rights are transferred from sending sites through the issuance of "Sending Area <br />Credits" pursuant to {cite Orange County code], a process which requires the grant of a conservation <br />easement restricting development on the Sending Site. <br />(3) SGRC certificates can be freely sold by the sending site landowner to whom they are issued. <br />Receiving site landowners who obtain SGRC certificates may use those certificates to obtain density <br />bonuses or other development incentives pursuant to applicable county regulations. <br />(4) Pursuant to [cite Orange County code], Grantors submitted an application to obtain a SGRC <br />Sending Area Certificate on ,(hereinafter "SGRC Certificate Application") for certain <br />real property (hereinafter "Protected Properly") owned by Grantors in fee simple and located in <br />Township, Orange County in the State of North Carolina, described in a deed to <br />Grantors, dated and recorded under Orange County Auditor's File No, <br />at Orange County Registry of Deeds. A legal description of the Protected Property is attached hereto as <br />Exhibit A and incorporated herein by reference as if set forth in full. <br />(5) The SGRC Certificate Application materials submitted by Grantors are on file with the <br />County, in the Land Use Records Management System under File No. ,and are <br />incorporated herein by reference as if set forth in full. These application materials detailed existing <br />conditions on the Protected Property and stated Grantors' intentions concerning future residential <br />development, if any, to occur on the Protected Property. The Grantors represent that these application <br />materials reflect existing conditions on the Protected Property as of the date this Easement is executed, as <br />well as the Grantors' intentions concerning future residential development, if any, to occur on the <br />Protected Property. <br />Orange County, North Carolina <br />
