SCRIPT FOR ACTING ON WHITE CROSS SOLAR LLC FOR SOLAR FACILITY OF WHITE <br /> CROSS ROAD <br /> CLASS A SPECIAL USE PERMIT APPLICATION: <br /> September 1, 2015 BOCC meeting <br /> 1. Chair will explain the purpose of the item is to receive the Planning Board <br /> recommendation. <br /> For the project, the purpose of the meeting is as follows: <br /> To receive the Planning Board recommendation, close the public hearing, and make a <br /> decision on a Class A Special Use Permit(hereafter`SUP) application submitted by White <br /> Cross Solar LLC and the property owners, Mr. and Mrs. William and Carol Byron, proposing <br /> the development of a solar array off of White Cross Road in accordance with Section 2.7 <br /> Special Use Permits and Section 5.9.6(C) Solar Array-Public Utility of the Orange County <br /> Unified Development Ordinance (UDO). <br /> 2. Chair will declare the public hearing re-convened for the purpose of receiving the <br /> Planning Board recommendation and ask staff to make their presentation. <br /> NOTE —The re-convening of a hearing is solely for the purpose of receiving the <br /> Planning Board recommendation and allowing any new information, previously <br /> submitted in writing, to be entered into the record. The hearing is not intended to solicit <br /> additional input from the public or the applicant. <br /> While the BOCC may ask staff questions related to the review of a given item, <br /> comments from the public or the applicant shall not be solicited. The accepting <br /> additional public comments at this stage of the review (i.e. the reconvened hearing) <br /> would constitute a violation of the UDO. <br /> 3. Staff will review the abstract and ask it be entered into the record. Staff will review the <br /> Findings of Fact (Attachment 5) for the Special Use component of the project. <br /> 4. Questions will be asked of staff. <br /> Commissioner Jacobs: Could you please just refresh my memory, since I wasn't at <br /> that Public Hearing. The response that's been incorporated to the North Carolina <br /> Wildlife Resources Commission. Concerns that are expressed in the letter that's <br /> included in our packet. If you go to page 14, <br /> there are following gentle recommendations, and I will stipulate number 1, Orange <br /> County is a leader in Environmental Protections; so most of the recommended stream <br /> buffer standards, or buffer standards we exceed by leaps and bounds. In our review, <br /> and that is specifically the local DEAPR office and the Planning Department in <br /> reviewing other County documents as well, there are no endangered species, or any <br /> other sensitive species on this property that would be impacted.
