39 <br /> applicant shall bear the burden of paying all fees associated with this inspection of the <br /> wastewater treatment facility as imposed by the Health Department. <br /> 8. That the applicant secure any necessary Soil Erosion and Grading, Stormwater, or other <br /> similar permit(s) from the Orange County Erosion Control Division, prior to any land <br /> disturbing activity occurring as part of the approved site plan. <br /> 9. That the applicant adhere to any conditions that may be imposed by North Carolina <br /> Department of Transportation in accordance with the driveway permit for this project. <br /> 10. That the provision of outdoor sports field lighting shall be deemed a SUP modification <br /> requiring the applicant to apply for a new Class A Special Use Permit as detailed within <br /> the UDO. <br /> 11. Development proposals shall be submitted to the North Carolina Division of Fish and <br /> Wildlife for review comment as part of the site plan review process of the County to <br /> ensure no endangered species are impacted. <br /> 12. The Special Use Permit will automatically expire in 12 months from the date of approval <br /> if the use has not commenced or construction has not commenced or proceeded unless <br /> a timely application for extension of this time limit is approved by the Board of <br /> Adjustment. <br /> 13. If any condition of this Special Use Permit shall be held invalid or void, then this Special <br /> Use Permit shall be void in its entirety and of no effect. <br />
