• Conduct the public hearing and accept public, BOCC, and Planning Board <br /> comment on the proposed amendments. <br /> • Refer the matter to the Planning Board with a request that a recommendation be <br /> returned to the BOCC in time for the September 1, 2015 BOCC regular meeting. <br /> • Adjourn the public hearing until September 1, 2015 in order to receive and <br /> accept the Planning Board's recommendation and any submitted written <br /> comments. <br /> Commissioner Dorosin asked if the building of a THCS is permissible, only if the <br /> recipient of the care is related to the landowner. <br /> Ashley Moncado said that is correct. <br /> Commissioner Dorosin asked if the THCS must be removed from the property, once the <br /> relative improves or moves on to a different living situation. <br /> Ashley Moncado said currently only one company makes this type of THCS, and they <br /> are built to be temporary. She said the THCS are built out of Virginia, where there are almost <br /> the same state regulations as North Carolina. She said the TCHS cost about $100,000, and <br /> there is no restriction on the word "temporary," so it could be on a property long term. <br /> Commissioner Rich asked if the TCHS remains on a property for many years, must it <br /> always be inhabited by the ailing relative. <br /> Ashley Moncado said yes. <br /> Commissioner Rich asked if there appears to be a need for the TCHS in Orange County. <br /> Ashley Moncado she said no one has gone through the process to be permitted, but <br /> there have been inquiries. <br /> Commissioner Price asked if a domestic partner would fall under the category of relative, <br /> and be able to reside in a TCHS. <br /> Ashley said that would apply for the family relationship. <br /> Commissioner Price asked for clarification regarding how water and sewer would work. <br /> Ashley said the applicant would have to go through Environmental Health to make sure <br /> that their present system has the capacity to accommodate this usage. <br /> Commissioner Price asked if this would also pertain to the Rural Buffer, and would <br /> Orange Water and Sewer Authority (OWASA) be involved. <br /> Ashley said yes, but properties in the rural buffer on mostly well and septic systems. <br /> A motion was made by Commissioner Rich, seconded by Commissioner Pelissier for the <br /> Board: To refer the matter to the Planning Board, with a request that a recommendation be <br /> returned to the BOCC in time for the September 1, 2015 BOCC regular meeting. <br /> VOTE: Ayes, 5; Nays, 1 (Commissioner Dorosin) <br /> Motion Passes <br /> Commissioner Dorosin said he likes the idea of the THCS, but he would like for the <br /> Board to consider amending the UDO, making such structures more accessible and the <br /> regulations less onerous. <br /> Commissioner Pelissier said the BOCC could direct the Planning Board to deliberate on <br /> this issue, and to consider other options before returning to the Board of County Commissioners <br /> with their recommendation. <br /> A motion was made by Commissioner Price seconded by Commissioner Pelissier to <br /> adjourn the public hearing until September 1, 2015 in order to receive and accept the Planning <br /> Board's recommendation and any submitted written comments. <br />
