Michael Harvey thanked the BOCC for their patience. He said that this proposed text <br /> amendment specifically seeks to amend existing regulations to allow for a third option with <br /> respect to the modification of an impervious surface limit. He reviewed the following PowerPoint <br /> presentation: <br /> MAY 26, 2015 <br /> QUARTERLY PUBLIC HEARING <br /> AGENDA ITEM:C-4 <br /> UNIFIED DEVELOPMENT ORDINANCE (UDO) TEXT AMENDMENT <br /> IMPERVIOUS SURFACE REGULATIONS <br /> BACKGROUND <br /> • Staff and Board members have received numerous inquiries related to increasing <br /> allowable impervious surface area. <br /> • Staff summarized issues/options in memo presented at the March 3, 2015 regular BOCC <br /> meeting. <br /> • BOCC authorized amendment process at its March 17, 2015 regular meeting. <br /> PROPOSAL <br /> • Proposed amendment seeks to allow additional impervious surface area through <br /> development and incorporation of an infiltration based stormwater feature, consistent <br /> with State allowances. <br /> • Feature has to be designed/certified by a professional (i.e. engineer) <br /> • Ordinance establishes a cap on the total amount of additional impervious surface area <br /> that can be placed on a property. <br /> • Property owner has to record maintenance agreement outlining perpetual <br /> care/maintenance of feature. <br /> EXAMPLE (Arial graphic) <br /> PEER REVIEW <br /> • Staff presented proposal to the Orange County Commission for the Environment (CFE), <br /> Orange Water Sewer Authority (OWASA) board, and submitted proposal to the planning <br /> staff of Chapel Hill and Carrboro for review. <br /> • In summary, while various entities expressed support for the proposal there was a <br /> universal concern the County lacks the staff resources to properly monitor and inspect <br /> these stormwater features in perpetuity to ensure their continued viability. <br /> RECOMMENDATION <br /> 1. Receive the application, <br /> 2. Conduct the Public Hearing and accept public, Planning Board, and BOCC sworn <br /> testimony, <br /> 3. Refer the matter to the Planning Board with a request that a recommendation be <br /> returned in time for the June 16, 2015 BOCC regular meeting, and <br /> 4. Adjourn the public hearing until June 16, 2015 in order to receive the Planning Board's <br /> recommendation and any submitted written comments. <br />
