26 <br /> 1 • Held in a quasi-judicial format meaning all parties, for and against the application, <br /> 2 provide sworn testimony as well as competent material and substantial evidence on the <br /> 3 merits of the proposal. <br /> 4 • Applicant has burden of demonstrating project complies with the provisions of the UDO. <br /> 5 • Anyone opposing the application is required to demonstrate through sworn testimony as <br /> 6 well as competent material and substantial evidence that the project does not comply <br /> 7 with the provisions of the Ordinance. <br /> 8 • Hearsay and/or unsubstantiated opinions are not considered sufficient testimony. <br /> 9 • If applicant proves compliance with applicable standards, and there is no evidence in the <br /> 10 record the project does not comply, the SUP must be issued. <br /> 11 <br /> 12 REQUEST <br /> 13 • Erect individual solar array panels on approximately 20 acres of property. <br /> 14 • Typical array is between 7 and 9 feet in height, with approximately 2 to 3 feet of ground. <br /> 15 clearance, and approximately 63 feet in length. <br /> 16 • Arrays will be screened by an installed 50 ft. wide Type D Land Use Buffer. <br /> 17 • An 8 foot high chain link security fence shall surround the perimeter of the 11.5 solar <br /> 18 array field, outside of the proposed land use buffer, to prevent access. <br /> 19 • Gravel paths/drives will be installed around these arrays in order to permit access by <br /> 20 technicians to service the panels.
