He said that this proposed text <br /> 3 amendment specifically seeks to amend existing regulations to allow for a third option with <br /> 4 respect to the modification of an impervious surface limit. He reviewed the following PowerPoint <br /> 5 presentation: <br /> 6 <br /> 7 MAY 26, 2015 <br /> 8 QUARTERLY PUBLIC HEARING <br /> 9 AGENDA ITEM:C-4 <br /> 10 UNIFIED DEVELOPMENT ORDINANCE (UDO) TEXT AMENDMENT <br /> 11 IMPERVIOUS SURFACE REGULATIONS <br /> 12 <br /> 13 BACKGROUND <br /> 14 • Staff and Board members have received numerous inquiries related to increasing <br /> 15 allowable impervious surface area. <br /> 16 • Staff summarized issues/options in memo presented at the March 3, 2015 regular BOCC <br /> 17 meeting. <br /> 18 • BOCC authorized amendment process at its March 17, 2015 regular meeting. <br /> 19 <br /> 20 PROPOSAL <br /> 21 • Proposed amendment seeks to allow additional impervious surface area through <br /> 22 development and incorporation of an infiltration based stormwater feature, consistent <br /> 23 with State allowances. <br /> 24 • Feature has to be designed/certified by a professional (i.e. engineer) <br /> 25 • Ordinance establishes a cap on the total amount of additional impervious surface area <br /> 26 that can be placed on a property. <br /> 27 • Property owner has to record maintenance agreement outlining perpetual <br /> 28 care/maintenance of feature. <br /> 29 <br /> 30 EXAMPLE (Arial graphic) <br /> 31 <br /> 32 PEER REVIEW <br /> 33 • Staff presented proposal to the Orange County Commission for the Environment (CFE), <br /> 34 Orange Water Sewer Authority (OWASA) board, and submitted proposal to the planning <br /> 35 staff of Chapel Hill and Carrboro for review. <br /> 36 • In summary, while various entities expressed support for the proposal there was a <br /> 37 universal concern the County lacks the staff resources to properly monitor and inspect <br /> 38 these stormwater features in perpetuity to ensure their continued viability. <br /> 39 <br /> 40 RECOMMENDATION <br /> 41 1. Receive the application, <br /> 42 2. Conduct the Public Hearing and accept public, Planning Board, and BOCC sworn <br /> 43 testimony, <br /> 44 3. Refer the matter to the Planning Board with a request that a recommendation be <br /> 45 returned in time for the June 16, 2015 BOCC regular meeting, and <br /> 46 4. Adjourn the public hearing until June 16, 2015 in order to receive the Planning Board's <br /> 47 recommendation and any submitted written comments. <br /> 48 <br />
