In March , the study indicates <br /> that we ha rain on March 1 , March '4 , March 5 , March 6 , <br /> March 8 , March 11 , March 14 , March 19 , March 20 , March 23, <br /> March 24 , March 25 , and 'March 27 . Accordingly, we believe <br /> that Marchl, for the most part , was far too wet to do. any <br /> grading ani corrective Work in the area. It should be <br /> Hated for April that we had rain on April 3, April 4 , <br /> April 8 , April 9 , April 13 , and April 1.4 , indicating <br /> that the first two weeks of April were basically very <br /> unsatisfactory to do any corrective work. <br /> In summary , we �ubmit - <br /> 1 . That wl certainly should have been given proper notice <br /> of the County Commissioners " meeting before action was taken. <br /> 2 . That Mr. Freeman failed to properly communicate with <br /> Goforth properties , Inc . about his dissatisfaction and <br /> that he further failed to follow through on commitments <br /> he made inlhis February 2nd letter that all further <br /> communications would be by certified mail and with an <br /> indicated 'deadline <br /> 3 . That Mr , Freeman should have indicated to Mr. Evans <br /> when Mr : Evans took over the job that there was a deadline <br /> and that we would be penalized if we did not meet that <br /> deadline . <br /> 4 . That the severe weather conditions in February, March, <br /> and April should have been taken into consideration before <br /> this penalty was imposed. <br /> 1 <br /> We are certainly not indicating that we believe that Goforth Properties <br /> Inc. had completely complied in all ways with the Soil and Erasion <br /> Ordinance. I do believe that. my representatives were negligent <br /> in not performing some of the work as fast as Mr. Freeman had <br /> requested and the Erosion Control Act. required. In that we <br /> completed all w�rk that Mr. Freeman required of us after the stop <br /> work order was issued in essentially a one-day period, it is <br /> certainly indicated that we were negligent in not having performed <br /> this work more expeditiously. I wish to state further that we <br /> have found Mr. Freeman very fair and very professional in carrying <br /> out his duties as the Soil. and Erosion Control Officer. We do, <br /> however, believe that he has been somewhat indefinite in his <br /> communications with our office and somewhat .indefinite about some <br /> of the procedures that he would like to have carried out within <br /> the subdivisions . We , accardinly, do not feel that we should be <br /> penalized for this lack of communication and for the misunderstanding <br /> that existed be�ween Mr . .Freeman and our office . In view of all <br /> the considerations stated here , we believe that the $5 ,000.00 <br /> penalty w4s ext- emely harsh and was an inappropriate procedure in <br /> this situation.
