L,1r _ Freeman, in his February 2 , 1979 :letter to us , <br /> indicatedjthat if we did not bring the site into compliance <br /> within fouul,x working days of that date that a stop work <br /> order Uoulld be issued and that such failure would be <br /> referred do the County Commissioners for additional action. <br /> No further correspondence was received by us indicating <br /> that the efforts being made were not satisfactory with <br /> Mr . Freeman. It was therefore our opinion that due to <br /> both weath�r conditions and subsequent conversations <br /> that our r presentative had with Mr. Freeman that we <br /> were satisfactorily meeting his requirements . In March <br /> of 1979 , M Freeman indicated to me that he was having <br /> difficulties with my field superintendent and believed <br /> that we would have a better working relationship and <br /> coiild get better results if I changed superintendents . <br /> 1 , accordingly, relieved Mr . Tian Fritz of this respon- <br /> sibility aid arranged for Mr. Vann Evans to meet with <br /> MT. Freeman. Mr. Evans met on the site with Mr. Freeman <br /> and with Mir. Neville , our subcontractor , and they discussed <br /> all the points of the February 2nd letter that had not <br /> been completed. It is Mr. Evans ' opinion that Mr. Freeman <br /> agreed that the work was to be performed within a reasonable <br /> time as th� weather permitted. It was neither Mr. Evans <br /> nor Mr. Neville' s understanding that Mx . Freeman indicated <br /> a deadline on the work. It should also be noted that a <br /> subsequent letter from Mi. Freeman on March 9 , 1979 , <br /> which discussed Section One Stoneridge Subdivision, did <br /> not in anyway indicate- that there was still dissatisfaction ,. <br /> with Section Two and Three of St'oneridge. It should also <br /> be noted tat l had not received any calls from Mr. <br /> Freeman indicating dissatisfaction with Mr. Evans or with <br /> Mr. Evans ° iperformance. It is clearly apparent that <br /> there was a breakdown in communication between Mr. Evans <br /> and Mr. Freeman. Mr. Freeman states in his February 2nd <br /> letter to �s that he was terminating all informal , verbal., <br /> and writze* contacts regarding sedimentation control . <br /> Tie states further that future contacts would be by certified <br /> letter wit deadlines for achieving compliance_ We did <br /> not receive any further communication from Mr . Freeman <br /> by certified mail subsequent to February 2 , 1979 indicating <br /> any furthe4 problems or any further difficulties . The <br /> only conta4t was a verbal contact made between Mr. Evans , , <br /> Mr. Freeman, and Mr. Neville. <br /> 3. The we�ther from February to April 13th was rather <br /> severe. TF e U. S. Weather Bureau report , a copy of <br /> which is aftached, indicates that on February 6th, <br /> we had 2 . 41inches of snow; on. February 7th; 2 . 9 inches <br /> of snow; oii February 9th, 1. 5 inches of snow; on <br /> February l th, 10. 3 inches of snow; and on February <br /> 19th, 1/10 h of one inch of snow. In addition, it <br /> is indicat d that we had rain on February 21 , February 22 , <br /> February 2 , February 24, and February 25 . It is <br /> certainly iiLi.cated from these weather conditions <br /> that very, ]it tle work could have been accomplished <br /> in Februar of 1979 due to the severe freezing <br />
